<br />KCHD ORDINANCE 1999- 52 SOLID WASTE REGULATIONS <br />d. No variance from Chapters 173-304 and 173-351 WAC shall be granted by the Health Officer <br />except with the approval and written concurrence of Ecology prior to action on the variance by the <br />Health Officer. The Health Officer may grant variances from these Board of Health regulations for <br />standards that are more stringent than the standards of Chapters 173-304 and 173-351 WAC, or <br />from provisions in these Board of Health regulations that are not contained in Chapters 173-304 and <br />173-351 WAC. <br />4. Renewal. <br />Any variance granted pursuant to this section may be renewed on terms and conditions and for periods <br />which would be appropriate on initial granting of a variance. No renewal thereof shall be granted, <br />unless following a public hearing on the complaint or due notice, the Health Officer finds the renewal is <br />justified. No renewal shall be granted except on application. Any such application shall be made at <br />least sixty (60) days prior to the expiration of the variance. Within ten (10) business days of receipt of <br />an application for renewal the Health Officer shall give public notice of such application in accordance <br />with these regulations. <br />G. Inspections <br />1. General. <br />At a minimum, quarterly inspections of all permitted solid waste facilities shall be performed by the <br />authorized representative of the Health Department. Findings shall be noted and kept on file. A copy <br />of the inspection report or annual summary shall be furnished to the site operator at the discretion of the <br />Health Officer or upon request. <br />2. Pre-Operational Inspection. <br />Whenever plans and specifications are required by these regulations to be submitted to the Health <br />Officer, the Health Officer shall inspect the proposed solid waste disposal site, solid waste handling <br />facility, or solid waste collection service prior to the start of the operations. <br />H. Imminent and Substantial Dangers <br />Notwithstanding any provisions of this regulation the Health Officer may take immediate action to prevent <br />an imminent and substantial danger to the public health by the improper management of any waste <br />irrespective of quantity or concentration. <br />SECTION VIII. ADDENDUM INCORPORATION <br />The Health Officer shall have the authority to adopt or incorporate any addenda or amendments to these <br />regulations, provided such addenda or amendments are not at variance with the Minimum Functional <br />Standards for Solid Waste Handling, Chapter 173-304 WAC, or the Criteria for Municipal Solid Waste <br />Landfills, Chapter 173-351 WAC, in accordance with due process of law. <br />SECTION IX. SEVERABILITY <br />Should any section, paragraph, phrase, sentence or clause of these regulations be declared invalid or <br />unconstitutional for any reason, the remainder of these regulations shall not be affected thereby.
