<br />KCHD ORDINANCE 1999- 50 SOLID WASTE REGULATIONS <br />the Health Department. The Health Department shall have the right to collect the amount expended <br />for abatement through appropriate legal action. <br />7. Other Legal or Equitable Relief. <br />Notwithstanding the existence or use of any other remedy, the Health Officer may seek legal or <br />equitable relief to enjoin any acts or practices or abate any conditions which constitute or will constitute <br />a violation of these regulations, or rules and regulations adopted under them. <br />8. Permit Suspension, Revocation, and Appeal. <br />a. Suspension of Permits. <br />(1) The Health Officer may temporarily suspend any permit issued under these regulations for: (a) <br />failure of the holder to comply with the requirements of the permit; (b) failure to comply with <br />any notice and order issued pursuant to these regulations related to the permitted activity; or <br />(c) the dishonor of any check or draft used by the permit holder to pay any fees associated with <br />the permit. <br />(2) Permit suspension shall be carried out through the notice and order provisions specified in <br />Section VII.E.3., and the suspension shall be effective upon service of the notice and order <br />upon the holder or operator. The holder or operator may appeal such suspension as provided <br />in Section VII.E.3.f. and Section VII.E.8.c. <br />(3) Notwithstanding any other provision of this regulation, whenever the Health Officer finds that <br />a violation of this regulation has created or is creating an unsanitary, dangerous or other <br />condition which, in his/her judgment, constitutes an immediate and irreparable hazard, he/she <br />may, without service of a written notice and order, suspend and terminate operations under the <br />permit immediately. <br />b. Revocation of Permits. <br />(1) The Health Officer may permanently revoke any permit issued by him/her for: (a) failure of <br />the holder to comply with the requirements of the permit; (b) failure of the holder to comply <br />with any notice and order issued pursuant to these regulations related to the permitted activity; <br />(c) interference with the Health Officer in the performance of his/her duties; (d) discovery by <br />the Health Officer that a permit was issued in error or on the basis of incorrect information <br />supplied to him/her; or (e) the dishonor of any check or draft used by the holder to pay any <br />fees associated with the permit. <br />(2) Such permit revocation shall be carried out through the notice and order provisions specified in <br />Section VII.E.3. and the revocation shall be effective upon service of the notice and order upon <br />the holder or operator. The holder or operator may appeal such revocation, as provided in <br />these regulations. <br />(3) A permit may be suspended pending its revocation or a hearing relative to revocation pursuant <br />to the provisions of Section VII.E.8.a. above. <br />c. Permit Appeal. <br />(1) Subject to Appeal. Any denial, suspension or revocation of a solid waste permit by the Health <br />Officer may be appealed.
