<br />KCHD ORDINANCE 1999- 48 SOLID WASTE REGULATIONS <br />Officer and need not be limited to those named in an order to correct violations. As a result of <br />information developed at the conference, the Health Officer may affirm, modify or revoke his/her <br />order. The administrative conference is optional with the Health Officer and is not a prerequisite to <br />utilization of any of the enforcement provisions described in these regulations. <br />f. Appeals. Appeals from any decision by the Health Officer made pursuant to these regulations, shall <br />be made to the Board of Health within the stated time period and in the following manner: <br />(1) Any bona fide party aggrieved by a decision or order of the Health Officer made pursuant to <br />these regulations pertaining to a solid waste handling or disposal site or facility in which the <br />person has an interest may file an appeal. <br />(2) Any appellant wishing to appeal the decision of the Health Officer must file in writing a <br />statement with the Health Officer within ten (10) calendar days of the date of serving of the <br />order. Such notice must be delivered personally to the Administration Office of the Kittitas <br />County Health Department (Attn: Health Officer) or sent by certified mail. The appellant <br />shall submit specific statements in writing of the reason why error is assigned to the decision <br />of the Health Officer, and which shall be accompanied by a fee as established in the current <br />Health Department fee schedule. <br />(3) When an appeal of the Health Officer's decision is made to the Board of Health, the filing of <br />such appeal shall stay the effective date of the decision until such time as the appeal is <br />adjudicated or withdrawn, unless in the opinion of the Board of Health such decision is <br />necessary to protect the immediate health and safety of the public. <br />(4) A Health Officer's decision which has been appealed in a timely manner shall be reviewed by <br />the Board of Health or designated Board of Health member(s). The review shall occur not less <br />than twenty (20) days and not more than thirty (30) days after service of the statement of <br />appeal upon the Health Officer. Parties shall be notified of the date of review by the Board of <br />Health or the designated Board of Health member(s). Both parties may submit additional <br />written information, if desired, for review by Board members. Such information must be <br />received by the Health Officer not fewer than five (5) working days prior to the hearing to <br />permit copying and mailing to Board members. <br />g. Supplemental Order to Correct Violation. The Health Officer may at any time add to, rescind in <br />part, or otherwise modify a notice and order to correct violation. The supplemental order shall be <br />governed by the same procedures applicable to all notice and order to correct violations procedures <br />contained in these regulations. <br />h. Finality of Order. <br />(1) Any order duly issued by the Health Officer pursuant to the procedures contained in this <br />regulation shall become final thirty (30) days after service of the order unless a written request <br />for hearing or statement of appeal is received by the Health Officer within the ten (10) day <br />period. <br />(2) An order which is subjected to the appeal procedure shall become final twenty (20) days after <br />mailing of the Board of Health's decision unless within that time period an aggrieved person <br />initiates review by writ of certiorari in Superior Court. <br />i. Enforcement of Final Order.
