<br />KCHD ORDINANCE 1999- 2 SOLID WASTE REGULATIONS <br />H. Wood debris resulting from the harvesting of timber and whose disposal is permitted under Chapter 76.04 <br />RCW, the State Forest Practices Act. <br />SECTION III. DEFINITIONS <br />When used in this regulation, the following terms have the meanings given below. Chapter 173-351,173-303, <br />and 173-304 WAC and (NESHAP) National Emission Standards for Hazardous Air Pollutants 40 CFR Part 61 <br />are hereby adopted by reference. <br />Active Area: That portion of a facility where solid waste recycling, reuse, treatment, storage or disposal <br />operations are being, are proposed to be, or have been conducted. Buffer zones shall not be considered part of <br />the active area of a facility. <br />Acute hazardous waste: Dangerous waste sources (listed in WAC 173-303-9004) F020, F021, F022, F023, <br />F026 or F027, and discarded chemical products (listed in WAC 173-303-9903) that are identified with a <br />dangerous waste number beginning with a “P”, including those wastes mixed with source, special nuclear, or <br />by-product material subject to the Atomic Energy Act of 1954. The abbreviation ‘AHW” will be used in this <br />ordinance to refer to those dangerous and mixed wastes which are acute hazardous wastes. Note – the terms <br />acute and acutely are used interchangeably. <br />Agricultural Wastes: Wastes on farms resulting from the production of agricultural products including, but <br />not limited to, manures and carcasses of dead animals weighing each or collectively in excess of fifteen (15) <br />pounds. <br />Aquifer: A geologic formation, group of formations or part of a formation capable of yielding a significant <br />amount of ground water to wells or springs. <br />Asbestos: Is a product that contains greater than 1% friable asbestos fibers by volume or weight.(Document 11 <br />of EPA Policy Compendium) “Asbestos includes chrysotile, amosite, crocidolite, tremolite asbestos, <br />anthophyllite asbestos, actinolite asbestos, and any of these minerals that have been chemically treated and/or <br />altered.”(WAC 196-62-77) <br />Asbestos Containing Material (ACM): Any waste that contains asbestos. This term includes asbestos waste <br />from control devices, materials used to enclose the work area during an asbestos project, asbestos containing <br />material(s) collected for disposal, or asbestos contaminated waste, debris, containers, bags, protective clothing, <br />or HEPA filters. Asbestos containing flooring or roofing materials shall not be considered ACM if: <br />1. The asbestos-containing flooring or roofing material is in good condition and is not peeling, cracking, <br />or crumbling; and <br />2. The binder is petroleum based, the asbestos fibers are suspended in that base, and individual fibers are <br />still encapsulated; and <br />3. The asbestos-containing flooring or roofing material does not have a friable asbestos backing or friable <br />asbestos layers in between layers of petroleum based binder; and <br />4. The building, vessel, or structure containing the asbestos-containing flooring or roofing material, <br />regardless of the condition of the material, will not be demolished by burning.
