3. Location of Alterations. New development shall be directed toward portions of a parcel or <br />parcels under contiquous ownership that are not subject to. or at risk from. geological <br />hazards and/or are outside anv setback or buffer established by this Chapter.4. Gritical Facilities Prohibited. Criticalfacilities shall not be sited within landslide. erosion. <br />alluvial fan. or mine hazard areas unless there is no other practical alternative.5. Review bv Qualified Professional. A oualified qeoloqist or enqineerino qeoloqist. or <br />professional enqineer licensed in the state of Washinqton. shall review development proiects <br />that occur in potentiallv qeoloqicallv hazardeus areas to determine the risk. lf development <br />takes place within an identified geoloqicallv hazardous area requirinq design or structural <br />elements to mitiqate the hazard. a report describinq the qeologicallv hazardous area and <br />conditions shall be prepared as described in KCC 17A.06.100. and the desiqn shall be <br />approved bv an qualified enqineerinq qeoloqist. or professional enqineer licensed in State of <br />Washinqton with expertise in oeoloqicallv hazard mitioation.6. Life of Structure. Prooosed developments shall be sited far enouoh from erosion and <br />landslide hazard areas to ensure at least one hundred (100) vears of useful life for the <br />proposed structure(s) or infrastructure. The location should be determined by a qualified <br />qeologist or engineering geolooist. licensed in the state of Washington and be should be <br />based on site specific evaluation of the landslide and/or erosion hazard. <br />174,06.040 Landslide Hazard Area Standards <br />1. Generallv. Alterations and development mav be allowed adiacent to landslide hazard areas. <br />provided that all responsible measures have been taken to minimize risks and other adverse <br />effects. and the amount and deqree of the alteration are limited to minimum needed to <br />accomplish the proiect purgose. Prior to approvinq a new alteration or development in or <br />adjacent to a landslide hazard area the Director shall determine that all the followinq <br />standards are met: <br />a. A minimum setback equal to the heiqht of the slope or 40 feet. whichever is qreater <br />or as recommended in an approved oeotechnical report: <br />b. The alteration or development includes all appropriate measures to eliminate. <br />reduce. or othenrvise mitioate risks to health and safetv:c. The alteration or development is located outside of a landslide hazard area and anv <br />required setback. as determined by a qualified enoineer. engineerinq geologist, or <br />qeologist. licensed in the state of Washinqton: <br />d. The alteration or development will not decrease slope stabilitv on adiacent <br />properties: <br />e. The alteration or development shall not increase the risk or frequencv of landslide <br />occurrences:f. The removal and disturbance of veoetation. clearino. or qradino shall be limited to <br />the area of the approved alteration or development:q. The alteration or development will not increase surface water discharqe or <br />sedimentation to adjacent properties beyond predevelopment conditions: <br />h. The proposed alterations will not adverselv impact other critical areas: andi. Structures and improvements includinq drainaqe and veqetation manaqement are <br />desiqned to have no impact on the slope stabilitv: andi. lf development takes place within an identified qeoloqicallv hazardous area. the <br />development must be desiqned to fully mitiqate the risk to the structure(s) and not <br />increase the risk to the public. other properties or public infrastructure or resources.2. Permitted Alterations and Development. The followinq alterations and development mav <br />be allowed in landslide hazard areas when all reasonable measures have been taken to <br />minimize risks and other adverse effects associated with landslide hazards. and when the <br />amount and deqree of alteration is limited to the minimum needed to accomplish the <br />alteration or development: <br />52
