submit to the County comolete information reqardinq the critical area on the <br />application for the underlvinq development. on forms provided by the countv. <br />b. As part of critical areas review. the County shall:i. Verifv the information submitted bv the applicant:ii. Evaluate the project area and vicinity for critical areas and buffers: <br />iii. Determine whether the aoplicant is required to seek additional critical area <br />consultation with qualified professionals and/or aqencies. which mav include <br />a ioint site visit with countv staff, aqencv staff. and/or qualified professionals: <br />(1) This additional consultation mav be required for. but is not limited to. <br />areas which contain unmapped critical areas and/or difficult mitiqation <br />circumstances. <br />iv. Determine whether the proposed development is likelv to impact the <br />functions or values of critical areas: andv. Determine if the proposed development avoids imoacts or adequatelv <br />addresses the impacts to the critical area and buffer associated with the <br />alteration or development.c. Make a review determination:i. No Critical Areas Present. lf after a site visit the director's analysis indicates <br />that the proiect area is not within or adiacent to a critical area or buffer and <br />lhat the proposed alteration or development is unlikely to deqrade the <br />functions or values of a critical then the director shall rule that the <br />critical area review is complete and note on the underlvinq application the <br />reasons that no further review is required. A summary of this information <br />shall be included in anv staff report or decision on the underlvinq permit. <br />ii. Critical Areas Present. but No lmpact - Waiver. lf the director determines <br />there are critical areas within or adjacent to the proiect area. but that the best <br />available science shows that the proposed alteration or development is <br />unlikely to deqrade the functions or values of the critical area(s) or buffer(s). <br />the director mav waive the requirement for a critical areas report. A waiver <br />mav be oranted if there is substantial evidence that all of the followino <br />requirements will be met: <br />(1) There will be no alteration of the critical area or associated riparian <br />management zone or buffer: <br />(2) The development proposalwill not neqativelv impact a critical area or <br />buffer. <br />iii. Critical areas may be affected by proposal. lf the director determines that a <br />critical area or areas or buffer(s) may be affected by the proposal. then the <br />director shall notify the apolicant that a critical areas report must be <br />submitted prior to further review of the project. as described in KCC <br />17A.01 .080. The director mav use the followinq indicators to assist in <br />determinino the need for a criticalareas report: <br />(1) lndication of a critical area on the countv critical areas maps that mav <br />be impacted bv the proposed alteration or development: <br />(2) lnformation and scientific opinions from appropriate aqencies. <br />includinq but not limited to the Washinqton State Departments of Fish <br />and Wildlife and Ecoloqv: <br />(3) Documentation. from a scientific or other reasonable source. of the <br />possible presence of a critical area: or <br />(4'l A findinq by a qualified professional. or a reasonable belief bv the <br />director. that a critical area mav exist on or adjErcent to the site of the <br />proposed alteration or development. <br />iv. <br />15
