health. safetv. or welfare. or that pose an immediate risk of damaqe to private <br />property and that require remedial or preventive action in a timeframe too shoft to <br />allow for compliance with the requirements of the critical areas regulations, provided <br />that:i. The emergency action shall have the least possible impacts to the critical <br />area and its buffer as is reasonably judqed in real time while still adequately <br />addressing the emerqency situation: <br />ii. The person or authorized representative of the agencv undertakinq such <br />action shall notifu the Countv within one (1) workinq dav following <br />commencement of the emerqencv alteration or development. Within thirtv <br />(30) davs. the Director shall determine if the action taken was within the <br />scope of the emerqencv actions allowed in this Subsection. lf the Director <br />determines that the action taken. or anv part of the action. was beyond the <br />scope of an allowed emeroency action. then the enforcement provisions of <br />KCC 17A.01.150 shall apply: and <br />iii. After the emerqency. the person or authorized reoresentative of the aqency <br />undertaking the action shall fully fund and conduct necessary restoration <br />and/or mitiqation for anv impacts to the critical area and buffers resultinq from <br />the emerqencv action in accordance with an approved critical areas report <br />and mitiqation plan. as described in 17A.01.080. The person orauthorized <br />representative of the aqencv undertakinq the action shall applv for review. <br />and the alteration. critical areas report. and mitiqation plan shall be reviewed <br />bv the Countv in accordance with the review nrocedrrres contained herein <br />Restoration and/or mitioation activities must be initiated within one (1) vear of <br />the date of the emeroency alteration or development and completed in a <br />timelv manner. <br />b. Operation. Maintenance. or Repair. Operation. maintenance, or repair of existino <br />structures. infrastructure improvements. utilities. public or private roads, dikes. <br />levees. or drainaoe svstems. that do not require construction permits. if the alteration <br />or development does not further chanse or increase the impact to. or encroach <br />further within. the critical area or buffer and there is no increased risk to life or <br />property as a result of the proposed operation. maintenance. or repair. Operation and <br />maintenance includes veqetation manaqement performed in accordance with best <br />manaqement practices that is part of onqoinq maintenance of structures. <br />infrastructure. or utilities. provided that such management actions are part of onqoing <br />maintenance. do not expand further into the critical area or buffer. are not the result <br />of an expansion of the structure or utilitv. and do not directly impact an endanqered <br />or threatened species.c. Passive Outdoor Activities. Recreation. education. and scientific research activities <br />that do not alter or deqrade the critical area or buffer, includino fishinq. hikinq. and <br />bird watchinq. <br />d. Forest Practices. Forest practices conducted in accordance with the requirements <br />of the Forest Practice Act (Chapter 76.09 RCW) and its rules. except for the <br />conversion of forest land to a use other than commercial forestrv (Class lV <br />conversions).Removal or Control of Terrestrial Noxious Weeds. Removal of <br />terrestrialweeds that are included on the State noxious weed list (WAC 16-750) or <br />other invasive plant species as identified bv Kittitas Countv. Control mav be <br />conducted bv clippinq. oulling. over-shadinq with native tree and shrub species, or <br />non-mechanized removal includino herbicide or other methods aoolicable to weed <br />control.e. Removal or Control of Aquatic Noxious Weeds. Removal or control of aouatic <br />noxious weeds. as defined in RCW 17.26.020. using an herbicide or other treatment <br />methods applicable to weed controlthat are recommended by a final environmental <br />6
