2021 Docket Enabling Ordinance December 7, 2021 <br />Page 33 <br /> <br /> <br />Exhibit M: Docket Item 21-13 <br /> <br />Amendment to Access Permits <br /> <br />12.05.050 Construction of Access. <br />A. The issued access permit will be provided to the permittee along with the requirements for <br />construction. The permittee will have 6 months the amount of time defined by the accompanying <br />building permit from the date of issuance, as shown on the permit, to complete construction of <br />the access and request inspection by the Department. In the absence of a building permit the <br />permittee will have 12 months from the date of issuance to complete construction and request <br />inspection by the Department. <br />B. An extension to the access permit will only be considered if construction of the access has been <br />substantially completed and the extension request is made prior to the permit expiration date. <br />The permittee can request an extension to the Department in writing. The Department will <br />determine if the approach has been substantially completed and determine the length of the <br />extension, if granted The construction of the access suitable to Public Works inspection staff <br />must complete prior to issuance of final occupancy. <br />C. The expected dates of construction and use of the access shall be included on the request for an <br />access. The permittee shall notify the Department at least 48 hours prior to any construction in <br />County right-of-way. <br />D. The Department shall inspect the access upon completion of construction to ensure that all terms <br />and conditions of the permit are met. The Department may request to inspect the access during <br />construction. <br />E. The construction of the access and its appurtenances as required by the terms and conditions of <br />the permit shall be completed at the expense of the permittee. <br />F. It is the responsibility of the permittee to complete the construction of the access according to the <br />terms and conditions of the permit. The Department may order a halt to any unauthorized <br />construction or use. <br />G. Adequate construction signing, in conformance with MUTCD, most recent edition, is required at <br />all times during access construction. This may include, but is not limited to, the use of signs, <br />flashers, barricades and flaggers. The Department and its duly appointed agents and employees <br />shall be held harmless against any action for personal injury or property damage sustained during <br />construction of the access. <br />H. The hours of work on or immediately adjacent to the highway may be restricted due to peak hour <br />traffic demands and other pertinent roadway operating restrictions. <br />I. A copy of the permit shall be available for review at the construction site. If necessary, minor <br />changes and additions may be ordered by the Department to meet unanticipated site conditions. <br />(Ord. 2015-010, 2015) <br />
