L. 91-190 <br />(1970) (codified as amended at 42 U.S.C. section 4321 et sq.) and the Councilon Environmentat Quality (CEe) Regutations <br />for lmplementing the Procedural Provisions of NEPA, which require recipients to use all practicable means within their <br />authority, and consistent with other essential considerations of national policy, to create and maintain conditions under which <br />people and nature can exist in productive harmony and fulfill the social, economic, and other needs of present and future <br />generations of Americans. <br />Artlcla Xl - Acknowledgement of Federal Fundlng from DHS <br />Recipients must acknowledge their use of federal funding when issuing staternents, press releases, requests for proposal, bid <br />invitations, and other documents describing projects or programs funded in whole or in part with federal funds. <br />Article Xll - USA PATRIOT Act of 2(Dl <br />Recipients must comply with requirements of Section 817 of the lJniting and Strerrytlwting America by Providing Appropriate <br />Tools Rquird to lntercept arr/d Qbstnnt Tenqism Act of 2001 (USA PATRIOT Act), Pub. L. No. 107:s6, wnicn amdnO's tA <br />U.S.C. sections 175-175c. <br />Artlcle Xlll - Age Dlscrlmlnation Act of 1975 <br />Recipients must comply with the requirements of the Age Discrimination Act of 1975, Pub. L. No. 94-135 (1975) (codified as <br />amended at Title 42, U.S. Code, section 6101 ef seg.), which prohibits discrimination on the basis of age in any program or <br />activity receiving federal financial assistance. <br />Article XIV - Givil Rights Act of 198{ - Title Vl <br />Recipients must comply with the requirements of Title Vl of the civil Rights Act of 1964 (codified as amended at 42 u.s.c. <br />section 2000d ef seg.), which Provides that no person in the United States will, on the grounds of race, color, or national origin, <br />be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or ac.tivity <br />receiving federal financial assistance. DHS implementing regulations for the Act are found at 6 C.F.R. part21 and q4 C. F. n. <br />Parl7. <br />Arficle XV - Applicabllity of DHS Standard Terms and Gonditions to Trtbes <br />The DHS Standard Terms and Conditions are a restatement of general requirements imposed upon recipients and flow dovrrn <br />to subrecipients as a matter of law, regulation, or executive order. lf the requirement does not appy to lndian tribes or there <br />is a federal law or regulation exempting its applioation to lndian kibes, then the acceflance by Tribes of, or acquiescenoe <br />to, DHS Standard Terms and Conditions does not change or alter its inapplioability to an lndian tribe. The exeoution of grant <br />docurnents is not intended to change, alter, amend, or impose additional liability or responsibility upon the Tribe where it does <br />not already exist. <br />Article XVI- Notic-e of Funding Opportunity Requirements <br />All the insfuctions, guidance, limitations, and other conditions set forth in the Notice of Fundirrg Opportunity (NOFO) for this <br />program are incorporated here S reference in the award terms and conditions. All recipients mr.rst comply wiih any such <br />requirements set forth in the program NOFO. <br />Article XVll - Trafficklng Victims Protection Act of 2000 (TVPA) <br />Recipierils must comply with the requirements of the government-wide financial assistarrce award term which implements <br />Section 106(9) of the Trafficking Victins Protection Act of 2000 IruPA), codified as amended at 22 U.S.C. section 7104.'the <br />award term is located at 2 C.F.R. section 175.15, the full text of which is inoorporated here by reference. <br />Artlcle XVlll - Acceptance of Post Award Changes <br />ln the etrent FEMA determines that changes are necessary to the award document after an award has been rnade, including <br />changes to period of performance or terms and conditiors, reoipients will be notified of tle changes in writing.
