6. For the purposes of this Development Agreement, "development standards" includes, <br />but is not limited to all of the standards listed in KCC 15A.11.020(5) and/or as <br />amended by the Marian Meadows Community Standards and Guidelines. <br />(Exhibit E). <br />7. KCC 15A.11.020(3) requires a development agreement to be consistent with applicable <br />county development regulations, except as such development regulations have been <br />modified by the development standards contained in the agreement. <br />8. Ordinance 2018-006 requires the Developer to enter this Development Agreement with <br />the County after consideration of (1) compliance with KCC 17.58 Airport Zone and <br />WSDOT Airport Safety Zones, (2) mitigation measures for the addition of 53 new <br />students to the Easton School District, (3) traffic and public infrastructure <br />improvements, (4) mitigation measures for the addition of 89 dwelling units, RV <br />storage, RV park, campground, and other approved commercial uses to Kittitas <br />County Fire District #3, and (5) water availability from Easton Water District. <br />9. The following events have occurred in the processing of the Developer's application: <br />a. After due notice, a public hearing was held before the Kittitas County Board of <br />County Commissioners on October 6, 2020, pursuant to KCC 15A.11.060; <br />b. The October 6, 2020 public hearing was continued until December 15, 2020, <br />where the Board of County Commissioners remanded the proposed development <br />agreement to the applicant for discussion on mitigation for impacts to Kittitas <br />County Fire District #3; <br />c. After due notice, a public hearing was held before the Kittitas County Board of <br />Commissioners on July 20, 2021, pursuant to KCC 15A.11, where the Board of <br />County Commissioners continued the public hearing until October 5, 2021 and <br />remanded the item to the applicant for further discussion with Fire District #3; <br />d. On October 5, 2021, after further opportunity for public comment, the Board of <br />County Commissioners voted to approve this Development Agreement. <br />10. The "Record" supporting the development, creation, approval, or potential appeal of this <br />Development Agreement shall include all records before the Board of County <br />Commissioners in considering Ordinance No. 2018-006, and all records before the <br />Kittitas County Hearing Examiner in considering the approval of the Marian <br />Meadows Planned Unit Development (PD -17-00001), Conditional Use Permit (CU - <br />17 -00001), and Plat (LP -17-00001). <br />AGREEMENT <br />Now therefore, the parties mutually agree as follows: <br />Development Agreement — Page 2 of 12 <br />
