the overall scale and intensity of such facilities and amenities shall not significantly exceed the <br />scale and intensity of such facilities and amenities analyzed in the MountainS tar EIS, (iii) the <br />location, quantity and type of Master Planned Resort Accommodation Units. provided overall <br />housing density at full build-out shall not exceed 4,650 Master Planned Reson Accommodation <br />Units, and (iv) changes allowed under Section 4.1 (g)(2) and Section 6. I. If. notwithstanding the <br />foregoing, the BOCC detennines that a proposed General Site Plan deviates significantly from <br />the Conceptual Master Plan or the Development Agreement, then the General Site Plan shall be <br />reviewed and acted upon by the BOCC following Community Development Services review and <br />recommendations and. should the BOCC so elect, the review and recommendation of the <br />Planning Commission. In order to approve a deviation from the Conceptual Master Plan or <br />Development Agreement proposed in a General Site Plan. the BOCC shall find that the probable <br />significant adverse environmental impacts associated with such deviation are the same as, or are <br />not significantly greater than, those impacts analyzed in the MountainStar EIS. In the event the <br />BOCC finds that any such significant deviation is likely to have new. probable significant <br />adverse impacts that are not mitigated. or impacts significantly greater than those analyzed in the <br />MountainStar EIS, the County shall conduct further environmental review under SEPA and may <br />impose additional mitigation conditions as deemed necessary, consistent with the Planned Action <br />Ordinance. All approved deviations shall be documented by the County, and, unless such <br />documentation indicates to the contrary. shall be allowed for Subsequent Actions without further <br />review or approval or statements required under Sections 5.1 (g)(3) or 5.1 (h)(ll )or amending <br />action under Section 6.2. <br />(d) Review and Approval of Site Development Plan. A Site Development <br />Plan shall be reviewed and approved by the County in the same manner as General Site Plans <br />Suncadia Master Pianned Reson Development Agreement (Amended and Restated 12-02-2008) Page 37 <br />Index #32
