(2) Life/Safety Road Standards. The County may impose the then- <br />current road standards n~cessary to address life/safety issues and concerns in accordance with the <br />provisions of EXHIBIT J (Rev. 1 ). provided that any such I ife/safet:y road standard shall apply to <br />MountainStar only to the extent such standard has been adopted by the County for application on <br />a county-wide basis. <br />(3) Processing Fees. Fees charged by the County which solely <br />represent the reasonable costs to the County for County staff time and resources spent reviewing <br />and processing Subsequent Approvals are referred to in this Agreement as ·'Processing Fees.'' <br />The County may charge Trendwest the applicable Processing Fees that are operative and in force <br />and effect at the time such fees are customarily required by the County to be paid. In addition, <br />Trendwest and the County shall enter into a staffing and cost reimbursement agrecmcnt(s) which <br />provides for Trendwest funding of additional County staff or consultant services necessary to <br />permit the expeditious processing of applications for Subsequent Actions without adversely <br />affecting the timely review of other approvals requested by third parties unrelated to this <br />Agreement. <br />( 4) Results of Monitoring. The County may impose additional <br />mitigation, may revise required timeframes or scopes of required mitigation. or may otherwise <br />impose additional conditions reasonably necessary to address the significant impacts identified in <br />the various monitoring reports required by the MPR Project Development Perrnit and <br />MountainStar MPR Conditions. lfthe results ofmonitoring demonstrate that impacts which are <br />the subject of mitigation conditions required by the MPR Project Development Permit or <br />MountainStar MPR Conditions no longer require such mitigation conditions. or that such <br />Suncadia Master Plann~d Resort Dt:veloprn~nl Agre~ment (Amended and Restated 12-02-2008) Page 32 <br />Index #32
