to and vested is set forth in Section 4.l(c) below. The effective date ofthe amendments contained in this Agreement shall be the date first above written. 1.2 Term. The tenn referenced in this Agreement (the "Tenn") shall commence upon the Effective Date and continue for a period of thirty (30) years, ending October 9. 2030. The date ofthis Agreement shall have no effect on the Tenn. 1.3 Review and Modification. Trendwest and the County shall review the terms of this Agreement within two (2) years from the Effective Date and every five (5) years thereafter to consider possible amendments thereto. This Agreement may be modified. extended or terminated upon the written agreement ofTrcndwcst and the County. Section 2. DEFI~ITIONS Unless the context requires a different meaning, any term or phrase used in this Agreement that has its first letter capitalized shall have that meaning given to it by this Agreement. Certain such terms and phrases arc defined below; others are defined where they appear in the text of this Agreement. including its Exhibits. "Affected Jurisdiction or Public Body" shall mean a public entity whose public service facilities are impacted by the development of MountainStar. As of the Effective Date, Affected Jurisdictions and Public Bodies to which this Agreement applies are as follows: Kittitas County. Kittitas County Sheriff, the City ofCie Elum, the City ofRoslyn. the Town of South Cle Elum. the Consolidated Communications Agency for Kittitas County (KlTTCOM). Kittitas County Fire Protection District No. 7, the Cle Elum-Roslyn School District. Hospital District No. 2 and the Washington State Department ofTransportation (WSDOT). Additional Affected Jurisdictions and Public Bodies may be added to this Agreement only with the mutual agreement of the Parties.
