Ordinance No. 98-20 on September 18. 1998, further amending the Revised MPR Policies on <br />remand from the Eastern Board to meet the requirements of RCW 36. 70A.l 00. By order dated <br />November 18, 1998, the Board held that the Revised MPR Policies, as amended, fully complied <br />with the GMA. The Eastern Board's November 18. 1998 order was not appealed. <br />2. On March 5, I 997. the County and Trendwest executed a "Development <br />Agreement Relating to Processing Master Planned Resort Application:· To the extent there is a <br />conflict between the March 5, 1997 Development Agreement and the 2000 Agreement <br />(hereinafter defined), the 2000 Agreement shall control. <br />3. On March 7. 1997, Trendwest submitted to the County a complete "MPR <br />Application'" seeking approval to develop MountainStar on the Trendwest Property. Under <br />Washington law. Trendwesrs MPR Application vested to those policies and regulations. <br />including the County's Original MPR Policies in effect on March 7, 1997. The MPR <br />Application requests the following approvals necessary for the development ofMountainStar: <br />(a) a site-specific amendment to the County's Comprehensive Plan land usc designation map <br />changing the designation of the Trendwest Property to Master Planned Resort (the <br />''Comprehensive Plan Amendment"): (b) a site-specific rezone ofthe County zoning map for the <br />Trendwest Property to a Master Planned Resort Zoning District (the ''Rezone'"); and (c) a MPR <br />Prqject Development Permit for the Mountain Star Conceptual Master Plan. The comprehensive <br />plan amendment to the land use designation map may include the adoption of a subarea plan for <br />the Trendwest Property to implement the County's Master Planned Resort Comprehensive Plan <br />policies described in Recitall( I) above (the "MountainStar Subarea Plan"). <br />4. On March 12, 1997, at the request ofTrendwcst, the County issued a <br />Determination of Significance under the Washington State Environmental Policy Act Ch. <br />Suncadia Master Planned Resort Dcvclopmenl Agreemen1 (Amended and Restated 12-02-2008) Page 6 <br />Index #32
