SPECIAL TERMS AND GONDITIONS <br />INTERAGENCY GMNT AGREEMENT <br />FEDERAL FUNDS <br />Program lncome shall be used to conlinue lhe same activities to benelit low- and moderate-income <br />persons or, with COMMERCE approval, for other activities to benefit low- and moderate-income <br />persons. lnterest earned in excess of 9100 on CDBG funds received to reimburse incuned costs must <br />be remltted to GOMMERGE for return to lhe U.S. Treasury. <br />14. PROHIETTTO=N qN C_EBJAIN FUNDS TBANSFERS <br />The Grantee that directly or indirectly recaives CDBG-CV funds may not sell, lrade, or othenrise <br />lransfer all or any such potion of such funds to another such entlty in exchange for any other funds, <br />credits or non-Federal consideralion, but must use such funds for activities eliglble under title I of the <br />HCD Act or permitted by waiver and alternative requirements that apply to the use of CDBG-CV funds. <br />15. SUBCONTRACTOR DATA COLLEGTION <br />Grantee will submit reports, in a form and format to be provided by Commerce and at intervals as <br />agreed by the parties, regarding work under lhis Grant performed by subcontractors and the portion of <br />funds expended for work perbrmed by subcontractors, including but not necessarily limited to minority- <br />owned, woman-owned, and veteran-owned business subcontraclorc. 'Subcontractors" shall mean <br />subcontractors of any tier, <br />16. SUBCONTRACTS FOR ENGTNEERil{G S_E_8VI9ES <br />Engineering firms must certity that they are authorized to do business in the state of Washington and <br />are in full compliance with the requiremenls of the Board of Professional Registration. The Grantee <br />shall require lhat engineering services providers be covered by errors and omissions insurance. The <br />engineering lirm shall maintain minimum limits of no less than $1 ,000,000 per occurrence to cover all <br />activities by the engineering firm and licsnsed staff employed or under contract to the engineering firm, <br />The state of Washington, its agents, officers, and employees need not be named as additional insureds <br />under this policy. <br />17. ORDEROF PRECEDENCE <br />ln lhe evenl of an inconsistency in lhis Grant, the inconsistency shall be resolved by giving <br />precedence in the following order: <br />. Applicable federal and state of Washington stalutes and regulationsr Special Terms and Conditions. General Terms and Conditionsr Attachment A - Scope of Work and Budget. Attachment B - Letter to lncur Cosl, if applicable.
