CFEMfi!-lK SETKIN & SAVE$ ns <br />December 15,2020 - the Board of commissioners remanded the proposed <br />Development Agreement back to ERLC ordering ERLC to engage in discussions with <br />the District to determine appropriate mitigation measures to include in the Development <br />Agreement. <br />December 28,2020 - ERLC's legal counsel sends a letter to the District demanding a <br />written response to outline mitigation for the Project, as well as an explanation for <br />mitigation on other developments within the District, though such a requirement was not <br />included in the Board of Commissioner's directive on December 15, 2020.5 <br />January 2021 - the District retains legal counselto assist in engaging in discussions <br />with ERLC as ordered by the Board of Commissioners. <br />January 27, 2021- the District's legal counsel sends an introduction letter to ERLC's <br />legal counsel, Dean Williams, and requests additional time (until March)to provide a <br />response to the December 28,2020, ERLC letter.6 <br />March 12,2021- the District's legal counsel provides a letter including proposed <br />mitigation conditions to ERLC.7 <br />March 19,2021- ERLC's legal counsel responds to the District's March 12th letter.s <br />Again, ERLC demanded that the District provide additional information which was not <br />required by Ordinance No. 2018-0006 or the directive of the Board of Commissioner on <br />December 15,2020. ln this letter, ERLC made a counteroffer to the mitigation <br />conditions identified by the District in its March 12th letter and requested that the District <br />consider this letter at its upcoming April Commission meeting.
