Since December 2A2A, ERLC and Easton Fire District # 3 (the "Distriit") have <br />exchanged several letters. See allctchnrents. Unfortunately, ERLC and the District have not been <br />able to agree on any material terms. A summary of these exchanges is as follows: <br />EILC sent an opening letter to the District on Decernber 28,2020, inviting the Distri* to supply <br />information about its mitigation requirements. On January 27,2021, the District responded that it <br />needed more time to provide the requested information, setting forth a list of "issues" that the <br />District would need to address "before agreeing to final mitigation procedures with ERLC." These <br />issues amounted to starting from the beginning, allowing the District time to assess its own <br />infrastructure and needs, in once-a-month meetings, as if the District had never heard of the Marian <br />Meadows proposal and had no idea that it was coming down the pipeline for the last ten years. <br />The District provided its first substantive response on March lZ, 2021. The District explained <br />several concerns raised by the Marian Meadows proposal, but also that "even with the mitigation, <br />the District will continue to seek to meet its response goals but cannot assure that they will be <br />met." MQrch I2 Leller at 4. The District provided a mitigation fee payment schedule that was <br />admittedly "not based on precisely calculated figures." Id. al34.Instead, the District took a take- <br />it-or-leave-it position based on ERLC's "timing goals." Again, the District has responded to <br />ERLC's inquiries as if it is just now becoming aware of this proposal, with no recogniiion of the20ll FEIS, and asserts that ERLC can accept the Disrict's numbers or wait for the District to <br />conduct an internal study. <br />Aside from the payment schedule, the District also asserted that, because the District does not have <br />a ladder truck, any and all structures in Marian Meadows would be limited to 2-stories and 24-feet. <br />l: ( llil -l-il-l8ll . lrr (.-ll5) ttt-lltl$I ll(r l St ll !
