Given some of the commentary in your letter, it is <br />necessary to place this matter on a better understanding of the circumstances and impact of the <br />Marian Meadows development on the District. For example, the District did not propose, nor did <br />it include in its preliminary cost estimates, an allocation of the full cost of necessary capital to <br />maintain existing levels of service while absorbing the demands anticipated from the Marian <br />Meadows development. The District reviewed what it believes is a fair and proportional share of <br />the costs of capital reasonably related to the impacts caused by the Marfan Meadows <br />development, without funding existing deficiencies. These costs are the proportional share <br />necessary to maintain existing levels of service. <br />Again, the District is prepared to enter into a voluntary mitigation agreement with your client and <br />allocate those funds to the District's capital requirements, consistenl with RCW 82.02. As a <br />result, your client can rest assured that the funds will be used for capital purposes. <br />The District has not had substantial development within its boundaries that would direcily or <br />indirectly cause any significant impact for at least the past 20 years. As a result, the District has <br />neither sought nor requested mitigation as there has not been a development that has had the <br />impact on existing services as your clienl's project would cause. Your lelter refers to <br />development wilhin the City of Cle Elum.
