ATTACHMENT 18-C (4) <br />Revised 1/25/2021 <br />Page 4 of 14 <br />7. SPECIAL CONDITIONS <br />A. Prevent Duplication of Benefit <br />The CARES Act provides that there are adequate procedures in place to prevent any <br />duplication of benefit as required by section 312 of the Robert T. Stafford Disaster Relief <br />and Emergency Assistance Act (42 U.S.C. 5155), as amended by section 1210 of the <br />Disaster Recovery Reform Act of 2018 (division D of Public Law 115–254; 132 Stat. 3442). <br />HUD requires each Grantee (and subrecipient) have procedures to prevent the <br />duplication of benefits when it provides financial assistance with CDBGCV funds. Federal <br />disaster law prohibits the provision of federal assistance in excess of need. Before paying <br />a cost with federal disaster assistance, the Grantee (and subrecipient) must check to see <br />that the assistance will not cause a duplication of benefits, meaning that the cost has not <br />or will not be paid by another source. Any person or entity (including subrecipients) <br />receiving CDBGCV assistance must agree to repay assistance that is determined to be <br />duplicative; and to assess whether the use of CDBGCV funds will duplicate financial <br />assistance already received or is likely to be received by acting reasonably, Grantees (and <br />subrecipients) must have a method to evaluate need and the resources available to meet <br />that need. CDBGCV funded activities will prevent, prepare for, and respond to the <br />coronavirus <br />8. GENERAL CONDITIONS <br />A. General Compliance <br /> The Subrecipient agrees to comply with: <br />• The requirements of Title 24 of the Code of Federal regulations, 570 (HUD regulations <br />concerning CDBG); and <br />• All other applicable Federal, State and Local laws, regulations, and policies, governing <br />the funds provided under this Agreement. <br />B. CDBG National Objective <br />The Subrecipient certifies the activities carried out under this Agreement meet a CDBG <br />Program National Objective defined in 24 CFR 570.208. <br />C. Independent Contractor <br /> Nothing contained in this Agreement is intended to, or will be construed in any manner, as <br />creating or establishing the relationship of employer/employee between the parties. The <br />Subrecipient will at all times remain an “independent contractor” with respect to the <br />services to be performed under this Agreement. The Local Government will be exempt <br />from payment of all Unemployment Compensation, FICA, retirement, life and/or medical <br />insurance and Workers’ Compensation Insurance, as the Subrecipient is an independent <br />contractor. <br /> <br /> <br /> <br />Doc ID: 7af681bb0ca653703df74fe4909e206e42be12f0
