Commercial development shall not result in a net loss of ecological functions that <br />have significant adverse impacts to other shoreline uses, resources and values, <br />such as navigation, recreation, and public access. <br />4. Public access and ecological restoration should be considered as potential <br />mitigation of impacts to shoreline resources and values for all water-related or water- <br />dependent development unless such improvements are demonstrated to be <br />infeasible or inappropriate. <br />5. Only those portions of water-dependent commercial uses that require over-water <br />facilities shall be permitted to locate watenrvard of the OHWM, provided they are <br />located on pilings or other open-work structures, and they are limited to the minimum <br />size necessary to support the structures intended use. <br />6. Non-water-dependent commercial uses shall not be allowed over-water except in <br />limited instances where they are appurtenant and necessary to support water- <br />dependent uses. <br />6.7 <br />A. <br />1.Dredging material disposal on land away from the shoreline is generally preferred <br />over open water disposal. <br />2. Dredging waterward of the OHWM for the primary purpose of obtaining fill material <br />should not be allowed, except when the material is necessary for the restoration of <br />ecological functions. <br />3. Disposal of dredge material on shorelands or wetlands within a river's channel <br />migration zone is discouraged. <br />B. Requlations <br />1. Dredging and dredge material disposal shall be done in a manner that avoids or <br />minimizes significant ecological impacts. lmpacts that cannot be avoided should be <br />mitigated in a manner that assures no net loss of shoreline ecological functions. <br />2. New uses and developments should be sited and designed to avoid or, where <br />avoidance is not possible, to minimize the need for new and/or maintenance <br />dredging. <br />3. Dredging forthe purpose of establishing, expanding, relocating, or reconfiguring <br />navigation channels and basins shall be allowed where necessary for assuring safe <br />and efficient accommodation of navigational uses and then only when significant <br />ecological impacts are minimized and mitigated. <br />Chapter 6 <br />March 7,2016 <br />Dredging and dredge material disposal <br />Policies <br />108
