Ecology WDFW shall base this <br />determination on identification during the comment <br />period of adverse impacts that cannot be mitigated <br />by the conditioning of a permit. If Ecology WDFW <br />determines that the review and approval process <br />created by this Section is not appropriate for the <br />proposed project, Ecology WDFW shall notify the <br />applicant and the appropriate local governments of <br />its determination. The applicant may reapply for <br />approval of the project under other review and <br />approval processes. Any person aggrieved by the <br />approval, denial, conditioning, or modification of a <br />permit under this Section may formally appeal the <br />decision to the Hydraulic Appeals Board pursuant to <br />the provisions of this chapter. <br />Chapter 17B.06 Elizabeth Torrey, <br />WDFW <br />1/5/2021 We request that you add language to the following <br />sections to indicate that these activities legally <br />require a Hydraulic Project Approval (HPA) permit <br />from WDFW before any work is performed: <br />17B.06.050 Boating facilities, marinas, piers, and <br />docks <br />17B.06.070 Dredging and dredge material disposal <br />17B.06.100 Industrial and port development <br />17B.06.120 Mining <br />17B.06.150 Shoreline stabilization <br />An HPA permit is a WDFW permit <br />for hydraulic projects in or near <br />state waters. It is not a <br />requirement under the SMA. <br />Staff does not recommend <br />approval of this proposed <br />change. <br />Channel Migration <br />Zone Maps <br />Elizabeth Torrey, <br />WDFW <br />1/5/2021 WDFW requests that Kittitas County formally adopt <br />the CMZ maps which have been in draft format since <br />2012. These maps should also be referenced <br />throughout the SMP document or provided in an <br />additional Appendix and thus made available for <br />reference by planners and the general public. These <br />maps would provide valuable information to the <br />Staff acknowledges WDFW’s <br />request to formally adopt the <br />CMZ maps.
