30Nondiscrimination:30.1TheCountyisanequalopportunityemployer.30.2NondiscriminationinEmploymentIntheperformanceofthisAgreement,theContractorwillnotdiscriminateagainstanyemployeeorapplicantforemploymentonthegroundsofrace,creed,color,nationalorigin,sex,sexualorientation,maritalstatus,ageorthepresenceofanysensory,mentalorphysicalhandicap;providedthattheprohibitionagainstdiscriminationinemploymentbecauseofhandicapshallnotapplyiftheparticulardisabilitypreventstheproperperformanceoftheparticularworkerinvolved.TheContractorshallensurethatapplicantsareemployed,andthatemployeesaretreatedduringemploymentwithoutdiscriminationbecauseoftheirrace,creed,color,nationalorigin,sex,sexualorientation,maritalstatus,ageorthepresenceofanysensory,mentalorphysicalhandicap.Suchactionshallinclude,butnotbelimitedto:employment,upgrading,demotionortransfers,recruitmentorrecruitmentadvertising,layoffortermination,ratesofpayorotherformsofcompensation,andprogramsfortrainingincludingapprenticeships.TheContractorshalltakesuchactionwithrespecttothisAgreementasmayberequiredtoensurefullcompliancewithlocal,stateandfederallawsprohibitingdiscriminationinemployment.30.3NondiscriminationinServicesTheContractorwillnotdiscriminateagainstanyrecipientofanyservicesorbenefitsprovidedforinthisAgreementonthegroundsofrace,creed,color,nationalorigin,sex,sexualorientation,maritalstatus,ageorthepresenceofanysensory,mentalorphysicalhandicap.30.4Ifanyassignmentand/orsubcontractinghasbeenauthorizedbytheCounty,saidassignmentorsubcontractshallincludeappropriatesafeguardsagainstdiscrimination.TheContractorshalltakesuchactionasmayberequiredtoensurefullcompliancewiththeprovisionsintheimmediatelyprecedingparagraphsherein.31.PrevailinqWaqe:Contractorshallpaytheprevailingrateofwagestoallworkers,laborers,ormechanicsemployedintheperformanceofanypartoftheWorkinaccordancewithRCW39.12andtherulesandregulationsoftheDepartmentofLaborandIndustries.ThescheduleofprevailingwagesratesforthelocalityorlocalitiesoftheWorkisdeterminedbytheProfessionalServicesAgreement(rev.09/24/2018)Page11of17
