enteringintoofanycooperativeagreement,andtheextension,continuation,renewal,amendment,ormodificationofanyfederalcontract,grant,loan,orcooperativeagreement.36.1.2.Ifanyfundsotherthanfederalappropriatedfundshavebeenpaidorwillbepaidtoanypersonforinfluencingorattemptingtoinfluenceanofficeroremployeeofanyagency,aMemberofCongress,anofficeroremployeeofCongress,oranemployeeofaMemberofCongressinconnectionwiththisfederalcontract,grant,loan,orcooperativeagreement,theundersignedshallcompleteandsubmitStandardForm-LLL,DisclosureFormtoReportLobbying,inaccordancewithitsinstructions.36.1.3.Theundersignedshallrequirethatthelanguageofthiscertificationbeincludedintheawarddocumentsforallsub-awardsatalltiers(includingsub-contracts,sub-grants,andcontractsundergrant,loans,andcooperativeagreements),andthatallsub-recipientsshallcertifyanddiscloseaccordingly.36.2.Thiscertificationisamaterialrepresentationoffactuponwhichreliancewasplacedwhenthistransactionwasmadeorenteredinto.SubmissionofthiscertificationisaprerequisiteformakingorenteringintothistransactionimposedbySection1352,Title31,U.S.Code.Anypersonwhofailstofiletherequiredcertificationshallbesubjecttoacivilpenaltyofnotlessthan$10,000andnotmorethan$100,000foreachsuchfailure.37.NONDISCRIMINATION(TitleVI,42U.S.C.§2000detseq.)37.1.DuringtheperformanceofthisAgreement,theSUB-RECIPIENTagrees:37.1.1.Tocomplywithallfederalnondiscriminationlawsandregulations,asmaybeamendedfromtimetotime.37.1.2.Nottoparticipatedirectlyorindirectlyinthediscriminationprohibitedbyanyfederalnon-discriminationlaworregulation,assetforthinAppendixBof49CFRPart21andherein.37.1.3.Topermitaccesstoitsbooks,records,accounts,othersourcesofinformation,anditsfacilitiesasrequiredbytheWTSC,USDOT,orNHTSA.37.1.4.That,intheeventacontractor/fundingrecipientfailstocomplywithanynondiscriminationprovisionsinthiscontract/fundingAgreement,theWTSCwillhavetherighttoimposesuchcontract/agreementsanctionsasitorNHTSAdetermineareappropriate,includingbutnotlimitedtowithholdingpaymentstothecontractor/fundingrecipientunderthecontract/agreementuntilthecontractor/fundingrecipientcomplies,and/orcancelling,terminating,orsuspendingacontractorfundingagreement,inwholeorinpart.37.1.5.Toinsertthisclause,includingallparagraphs,ineverysub-contractandsub-agreementandineverysolicitationforasub-contractorsub-agreementthatreceivesfederalfundsunderthisprogram.38.POLITICALACTIVITY(HATCHACT)TheSUB-RECIPIENTwillcomplywithprovisionsoftheHatchAct(5U.S.C.1501-1508),whichlimitthepoliticalactivitiesofemployeeswhoseprincipalemploymentactivitiesarefundedinwholeorinpartwithfederalfunds.
