Cook <br />RECOMMENDATION: <br />Direct staff to prepare enabling legislation. <br />BRIEFING SUMMARY: <br />• Public Works (PW) is required to certify compliance with Federal non- <br />discrimination reporting to the Federal Highway Administration for all federal <br />grants received. <br />• PW last reported for Fiscal Year 2017. <br />• PW desires reporting for 2018, 2019 and 2020. <br />• No audit has been requested by Local Programs. <br />• The ramifications of catching up our reporting obligations is unknown. <br />BACKGROUND: <br />PW last reported on Title VI actions for fiscal year 2017. An annual report is required <br />when federal money is used on Road Fund projects or when the Chief Administrative <br />Officer changes at the County. PW presumes a change in Board Chair triggers the <br />reporting requirement. Either federal grant money was utilized, or we had a change in <br />County Commission Chair during 2018, 2019 and 2020. PW did not produce the <br />required Title VI reporting. <br />DISCUSSION: <br />Producing enabling legislation will address the missing reports for 2018, 2019 — 2020 is <br />now one month late. The Non -Discrimination Agreement (NDA) contains significant <br />elements that remain unchanged since our last filing in February 2018. The NDA is <br />being added to the list of year end close out documents that will be managed by the <br />County Engineer as supported by the Finance Division of PW. <br />FISCAL IMPACTS: <br />Unknown.
