ADDENDUM TO AGREEMENT FOR KITTITAS COUNTY SUPERIOR COURT INDIGENT DEFENSE SERVICES (2021) This Addendum is entered into by and between the County of Kittitas (County)and the SuperiorCourtofWashingtoninandforKittitasCountyandCandyK.Powers (Contracting Attorney,WSBA #06705).All prior provisions and terms of the original Agreement for Kittitas CountySuperiorCourtIndigentDefenseServicesfor2021remaininfullforceandeffectwiththeexceptionstoparagraph10,l 1,and 12 which are amended as follows: 10.Term of Agreement.Provision of services pursuant to this Agreement shall commenceMarch1,2021 and terminate on December 31,2021,unless this Agreement is terminated earlierpursuanttotheprovisionsofParagraph18,and the Contracting Attomey shall provide service to all defendants referred herein in accordance with the terms of this Agreement until representationofsuchdefendantiscomplete,as provided in Paragraph 1 of this Agreement.This Agreement shall apply to all referrals made through December 31,2021,unless the contract is terminatedearlier,in which case the contract shall apply to all referrals made until 5:00 p.m.on the date ofterminationofthecontract, 11.Scope of Work.Over the course of this contract the Contracting Attomey (and any associated or employed counsel)shall handle a caseload of up to,but no more than 114 felony cases,or an average number of 11.40,plus 21 juvenile offender cases in that period,an averageof2.1 per month. 12,Compensation.The Contracting Attorney shall be paid as follows: The sum of one hundred thirteen thousand and four hundred twelve dollars ($113,412)per yearpaidinequalmonthlyinstallmentsonthesecondMondayofthemonth. •Jury Trial:Shall be paid an additional $375 per diem for jury trial.The Contracting AttorneyshallprovideinvoicestotheCourtAdministratorforalltrialperdiempay.Those invoices will be provided within 30 days of the last day of trial.
