Cook <br />RECOMMENDATION: <br />Prepare enabling legislation and schedule the required public hearing. <br />BRIEFING SUMMARY: <br />• Dedicated plat public right of way inside a private subdivision. <br />• Road was never built. <br />Lot owner desires clearing title and having full use of the property. <br />Public Works (PW) supports the requested vacation with no value for the vacated <br />right of way. <br />BACKGROUND: <br />Within the plat of "Timber Valley"; large portions of Little Creek Road and Timber <br />Valley Road were not constructed. A portion of Nelson Creek Road was also not <br />constructed. The property owner of lots 100-103 and 87-90, has dedicated public right of <br />way separating his lots (see EXHIBIT 1). Because that the right of way is dedicated for <br />public use, Public Works is required to vacate pursuant to county code and state law. <br />DISCUSSION: <br />The requested vacation preserves access to an adjoining parcel as thirty (30) feet are <br />reserved for a future private driveway. The action allows parcels 87-103 to be joined and <br />the property owner is no longer burdened by the right of way. PW is proposing that no <br />value be assigned to the right of way as no improvements have been created impacting <br />any Road Fund expenditures. A subsequent record of survey by the property owner will <br />clear title and allow full use of the proponent's property. PW supports the requested <br />vacation of a portion of Nelson Creek Road and a portion of Little Creek Road (legal <br />description attached as EXHIBIT 2). <br />FISCAL IMPACTS: <br />The applicant has paid PW's vacation application fee of $4,205.00. <br />Page 1 of 4 <br />Public Works "Work Session Staff Report", 2021 <br />
