undertakenorlocated,andnootherofficialoftheSubrecipientwhoexercisesanyfunctionsorresponsibilitieswithrespecttotheprojectduringhisorhertenure,shallhaveanypersonalorpecuniarygainorinterest,directorindirect,inanycontract,subcontract,ortheproceedsthereof,forworktobeperformedinconnectionwiththeprojectassistedunderthisAgreement.TheSubrecipientshallincorporate,orcausetoincorporate,inallsuchcontractsorsubawards,aprovisionprohibitingsuchinterestpursuanttothisprovision.A.10CONTRACTING&PROCUREMENTa.TheSubrecipientshalluseacompetitiveprocurementprocessintheprocurementandawardofanycontractswithcontractorsorsubcontractorsthatareenteredintoundertheoriginalagreementaward.Theprocurementprocessfollowedshallbeinaccordancewith2CFRPan200.318Generalprocurementstandardsthrough200.326Contractprovisions.AsrequiredbyAppendixIlto2CFRPart200,allcontractsenteredintobytheSubrecipientunderthisAgreementmustincludethefollowingprovisions,asapplicable:1)Contractsformorethanthesimplifiedacquisitionthresholdcurrentlysetat$150,000,whichistheinflationadjustedamountdeterminedbytheCivilianAgencyAcquisitionCouncilandtheDefenseAcquisitionRegulationsCouncil(Councils)asauthorizedby41U.S.C.1908,mustaddressadministrative,contractual,orlegalremediesininstanceswherecontractorsviolateorbreachcontractterms,andprovideforsuchsanctionsandpenaltiesasappropriate.2)Allcontractsinexcessof$10,000mustaddressterminationforcauseandforconveniencebythenon-federalentityincludingthemannerbywhichitwillbeaffectedandthebasisforsettlement.3)EqualEmploymentOpportunity.E×ceptasotherwiseprovidedunder41CFRPart60,allcontractsthatmeetthedefinitionof"federallyassistedconstructioncontract"in41CFRPart60-1.3mustincludetheequalopportunityclauseprovidedunder41CFR60-1.4(b),inaccordancewithExecutiveOrder11246,"EqualEmploymentOpportunity"(30FR12319,12935,3CFRPart,1964-1965Comp.,p.339),asamendedbyExecutiveOrder11375,"AmendingExecutiveOrder11246RelatingtoEqualEmploymentOpportunity,"andimplementingregulationsat41CFRpart60,"OfficeofFederalContractCompliancePrograms,EqualEmploymentOpportunity,DepartmentofLabor."4)Davis-BaconAct,asamended(40U.S.C.3141-3148).WhenrequiredbyFederalprogramlegislation,allprimeconstructioncontractsinexcessof$2,000awardedbynon-federalentitiesmustincludeaprovisionforcompliancewiththeDavis-BaconAct(40U.S.C.3141-3144,and3146-3148)assupplementedbyDepartmentofLaborregulations(29CFRPart5,"LaborStandardsProvisionsApplicabletoContractsCoveringFederallyFinancedandAssistedConstruction").Inaccordancewiththestatute,contractorsmustberequiredtopaywagestolaborersandmechanicsataratenotlessthantheprevailingwagesspecifiedinawagedeterminationmadebytheSecretaryofLabor.Inaddition,contractorsmustberequiredtopaywagesnotlessthanonceaweek.Thenon-federalentitymustplaceacopyofthecurrentprevailingwagedeterminationissuedbytheDepartmentofLaborineachsolicitation.Thedecisiontoawardacontractorsubcontractmustbeconditionedupontheacceptanceofthewagedetermination.Thenon-federalentitymustrepodallsuspectedorreportedviolationstothefederalawardingagency.ThecontractsmustalsoincludeaprovisionforcompliancewiththeCopeland"Anti-Kickback"Act(40U.S.C.3145),assupplementedbyDepartmentofLaborregulations(29CFRPart3,"ContractorsandSubcontractorsonPublicBuildingorPublicWorkFinancedinWholeorinPartbyLoansorGrantsfromtheUnitedStates").TheActprovidesthateachcontractororSubrecipientmustbeprohibitedfrominducing,byanymeans,anypersonemployedintheconstruction,completion,orrepairofpublicwork,togiveupanypartofthecompensationtowhichheorsheisotherwiseentitled.Thenon-federalentitymustreportallsuspectedorreportedviolationstothefederalawardingagency.5)ContractWorkHoursandSafetyStandardsAct(40U.S.C.3701-3708).Whereapplicable,allcontractsawardedbythenon-federalentityinexcessof$100,000thatinvolvetheemploymentofmechanicsorlaborersmustincludeaprovisionforcompliancewith40U.S.C.3702and3704,assupplementedbyDepartmentofLaborregulations(29CFRPart5).Under40U.S.C.3702oftheAct,eachcontractormustberequiredtocomputethewagesofeveryDHS-FEMA-HSGP-SHSP-FFY18Page12of38KittitasCountySheriffsOffice,E21-187
