e - <br />COOPERATIVE AGREEMENT <br />Fish Lake Road <br />0 <br />This Agreement, made and entered into this 22nd day of June, 1993, by and <br />between the FOREST SERVICE, U.S. DEPARTMENT OF AGRICULTURE, hereinafter <br />called "Forest Service.", and the COUNTY OF KITTITAS, hereinafter called "County". <br />Purpose of Agreement: The purpose of this Agreement is to set forth the <br />general terms and conditions, acceptable- to the parties hereto, for the cooperative <br />planning, survey, design, construction, reconstruction, improvement, and maintenance <br />of the Fish Lake Road in Kittitas County, State of Washington, pursuant to the <br />provisions of 16 U.S.C. 532-528, 23 U.S.C. 205 and the regulations issued by the <br />Secretary of Agriculture. <br />WHEREAS, the Fish Lake Road from the and of Salmon La Sac Road to Fish <br />Lake is a public road, not on the county road system but is designated as a county <br />road; and <br />WHEREAS, the Fish Lake Road is heavily used by the public as access. to <br />National Forest lands in the area; and <br />WHEREAS, the Fish Lake Read is occasionally used for commercial timber haul <br />from National Forest and private lands; and <br />WHEREAS, FOREST SERVICE and COUNTY agree that the Fish Lake Road <br />needs to be maintained to safely and efficiently accommodate public and commercial <br />use; <br />NOW, THEREFORE, it Is agreed that FOREST SERVICE, through its own crews <br />and contracts, will maintain and reconstruct the Fish Lake Road as it deems necessary <br />and desirable to provide access to the public to National Forest lands. Such <br />maintenance will include preserving and keeping the road open and maintained for <br />travel by a prudent driver in a standard passenger car. User comfort and convenience <br />is not considered a priority.
