BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO.2020-__Ljh._ <br />A RESOLUTION ALLOWING FOR PROVISIONS OF THE BUILDING OFFICIAL, <br />FIRE MARSHAL, PLANNING OFFICIAL AND CDS DIRECTOR TO EXEMPT SOME <br />REQUIREMENTS OF THE NON-RESIDENTIAL BUILDING, FIRE, AND LAND USE <br />CODES AND REGULATIONS ON AN EMERGENCY AND TEMPORARY BASIS <br />WHEREAS: a state of emergency has been declared, nationally, statewide, and locally due to <br />the outbreak of the coronavirus; and <br />WHEREAS: some temporary code exemption is a necessary component of both our emergency <br />and economic response to that emergency; and <br />WHEREAS, the strict compliance with all building, fire and land use codes creates an <br />economic and urgent hardship on local businesses trying to adapt to and comply <br />with the Governor's orders on a temporary basis; and <br />WHEREAS, RCW 38.52.070(2) gives the board of county commissioners certain broad powers <br />in times of emergency for "providing emergency assistance to the victims of such <br />disaster"; and <br />WHEREAS, the below named officials are capable of making informed decisions based on <br />their professional knowledge with regard to the essential safety aspects of such <br />temporary exceptions to strict adherence, with the goal of applying reasonable <br />standards to temporary changes. <br />NOW THEREFORE BE IT RESOLVED that, pursuant to the emergency authority granted to <br />the county board of commissioners in RCW 38.52.070(2), the Building Official, Fire Marshal, <br />Planning Official and CDS Director are hereby allowed to exempt non-residential, commercial <br />businesses from total compliance with the Building, Fire and Land Use codes and regulations <br />using their professional discretion for the duration of the current declaration of emergency <br />related to the coronavirus outbreak. <br />This grant of a special emergency use does not relieve the business owners of, nor substitute for, <br />any state licensing requirements for provisions of operation. <br />DATED this 23rd day of November , 2020, at Ellensburg, Washington. <br />
