entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or
<br />modification of any federal contract, grant, loan, or cooperative agreement.
<br />36,1,2.If any funds other than federal appropriated funds have been paid or will be paid to any person for
<br />influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an
<br />officer or employee of Congress, or an employee of a Member of Congress in connection with this federal
<br />contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-
<br />LLL, Disclosure Form to Report Lobbying, in accordance with its instructions.
<br />36.1.3. The undersigned shall require thatthe language of this certification be included in the award
<br />documents for all sub-awards at all tiers (including sub-contracts, sub-grants, and contracts under grant, loans,
<br />and cooperative agreements), and that all sub-recipients shall certify and disclose accordingly.
<br />36.2. This ceftification is a material representation of fact r"rpon which reliance was placed when this
<br />transaction was made or entered into. SLrbmission of this certification is a prerequisite for making or entering
<br />into this transaction imposed by Section 1352, Title 31, U.S. Code. Any person who fails to file the required
<br />certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each
<br />such failure.
<br />37. NONDISCRIMINATION (Title VL,42 U.S.C. $ 2000d et seq.)
<br />37.1. During the performance of this Agreement, the SUB-RECIPIENT agrees
<br />37.1.1, To comply with all federal nondiscrimination laws and regulations, as may be arnended from time to
<br />time.
<br />37.1.2. Not to participate directly or indirectly in the discrimination prohibited by any federal non-
<br />discrimination law or regulation, as set forth in Appendix B of 49 CFR Part 2l and herein.
<br />37.1.3. To perrnit access to its books, records, accounts, other sources of information, and its facilities as
<br />required by the WTSC, USDOT, or NHTSA.
<br />37.1.4. That, in the event a contractor/funding recipient fails to comply with any nondiscrimination provisions
<br />in this contract/funding Agreement, the WTSC will have the right to impose such contract/agreement
<br />sanctions as it or NHTSA determine are appropriate, including but not Iimited to withholding payments to the
<br />contractor/funding recipient under the contract/agreement Lrntil the contractor/funding recipient complies,
<br />and/or cancelling, terminating, or suspending a contract or funding agreement, in whole or in parl.
<br />37.1.5. To insert this clause, including all paragraphs, in every sub-contract and sub-agreement and in every
<br />solicitation for a sub-contract or sub-agreement that receives federal funds under this program.
<br />38. PO CAL ACTIVITY TCH ACT)
<br />The SUB-RECIPIENT willcomply with provisions of the Hatch Act (5 U.S.C. l50l-1508), which limit the
<br />political activities of employees whose principal employment activities are funded in whole or in part with
<br />federal funds.
