D17-1016 <br />Amendment A <br />Attachment 5 <br />Replace these numbered paragraphs of the original agreement with the following new paragraphs: <br />SPECIAL TERMS AND CONDITIONS <br />ARTICLE I — COMPENSATION SCHEDULE <br />FUNDING <br />The DEPARTMENT will administer the Fire Management Assistance Grant Program and reimburse to <br />the SUBRECIPIENT approved eligible fire management assistance costs and approved allowable grant <br />administration costs identified in Project Worksheets pursuant to Fire Management Assistance Grant <br />declaration number FEMA 5200 -FM -WA, (Jolly Mountain Fire), consistent with 44 CFR Part 204 and <br />the Washington State Fire Management Assistance Grant 2017 Applicant Manual (Attachment 4). <br />The Parties agree that no final dollar figure is committed at the time that this Agreement is executed, <br />but that financial commitments will be made by amendments to the project application as Project <br />Worksheets are completed in the field and projects are authorized by state and federal officials. See <br />Attachment 3 - Project Worksheet Sample. <br />Pursuant to the FEMA -STATE AGREEMENT, FEMA will contribute not less than 75 percent (federal <br />match) and the SUBRECIPIENT will commit not less than 25 percent (non-federal match) of the eligible <br />costs for any eligible project for the SUBRECIPIENT that has been identified under the Fire <br />Management Assistance Grant declaration number FEMA 5200 -FM -WA, subject to the following <br />exceptions: <br />DEPARTMENT Match: The Washington State Legislature may authorize the DEPARTMENT to provide <br />a portion of the SUBRECIPIENT's non-federal match of eligible projects. Provision of a portion of the <br />non-federal match by the DEPARTMENT, if authorized by the Washington State Legislature, shall not <br />require amendment of this Agreement. If the DEPARTMENT commits to provides non-federal match <br />funds, the DEPARTMENT will formally notify the SUBRECIPIENT in writing, which will include <br />information identifying any related reduction in the SUBRECIPIENT's percentage commitment. <br />Donated Resources: FEMA may credit a SUBRECIPIENT for the value of certain volunteer labor, <br />donated equipment, and donated materials used to meet the immediate threat to life and property <br />resulting from the declared fire, referred to as "Donated Resources". The Donated Resources are <br />submitted to FEMA in a Project Worksheet. FEMA will subsequently issue its decision. Approved <br />Donated Resources offset the non-federal match of the eligible emergency work approved in Project <br />Worksheets. For non -state agency SUBRECIPIENTS, the donated resource value will first be applied <br />to the SUBRECIPIENT's non-federal match, and, if a DEPARTMENT match is authorized, any <br />remaining donated resource value will be applied to the DEPARTMENT's match. The value of any <br />approved Donated Resources are calculated as described in FP 9525.2 — Donated Resources (2014), <br />and are capped at the non -Federal match of approved eligible emergency work costs. The Federal <br />match of the Donated Resources will not exceed the non-federal match of eligible emergency work <br />costs approved in Project Worksheets. Any excess credit can be credited only to other eligible <br />emergency work costs, for the same SUBRECIPIENT in the same disaster. The value of excess <br />donated resources cannot be credited toward or transferred to another eligible SUBRECIPIENT, or <br />toward other State obligations.
