Operations Plan <br />the Operations Plan <br />Station <br />d) Independent Contractor. The Company shall perform all work under this <br />Agreement as an Independent Contractor. The Company is not and shall not <br />be considered an employee, agent or servant of the County. <br />8. HOURS AND DAYS OF OPERATIONS. The Ellensburg Transfer Station tipping area shall be <br />open to the general public to receive waste from 8:00 a.m. to 4:00 p.m., Monday through Saturday. In <br />addition, the Company shall be entitled to receive wastes from the waste hauling companies before or <br />after hours, provided that the card lock and video camera systems are in place and operational. The <br />Company shall be responsible, at its sole expense, for installing and maintaining additional cameras to <br />be hooked to the County's system to insure all traffic before or after hours is recorded. Additional hours <br />of operation may be approved by the County as long as the Company provides at least one transfer <br />station employee on-site. <br />The Upper County Transfer Station tipping area shall be open to receive waste from 8:00 a.m. to <br />1:00 p.m. and from 1:30 p.m. to 4:00 p.m., Tuesday through Saturday. In addition, the Company shall <br />be entitled to receive wastes from the waste hauling companies before or after hours, provided that the <br />card lock and video camera systems are in place and operational. The Company shall be responsible, at <br />its sole expense, for installing and maintaining additional cameras to be hooked to the County's system <br />to insure all traffic before or after'hours is recorded. Additional hours of operation may be approved by <br />the County as long as the Company provides at least one transfer station employee on-site. <br />The transfer stations shall be closed to the general public on the following legal holidays: New <br />Year's Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, <br />Veterans Day, Thanksgiving Day and the day after, and one-half day (closing time is noon) before <br />Christmas and all day Christmas Day. <br />The transfer stations shall be closed to waste hauling companies on the following legal holidays: <br />New Year's Day, Thanksgiving Day, and Christmas Day. If the County card lock system is inoperable <br />for any reason, the hauling company will not be allowed access to the transfer stations. <br />15
