Cook <br />RECOMMENDATION: <br />Authorize the City of Ellensburg to subcontract with the <br />Ellensburg Business Development Authority for 2019 Public Facilities Funding <br />BRIEFING SUMMARY: <br />• Public Facility grant agreements do not allow subcontracting without written <br />approval from the Kittitas County Board of County Commissioners (BOCC) <br />• The Board of County Commissioners approved 2019 distressed county fund <br />awards pursuant to Resolution 2019-164 <br />• The City of Ellensburg was awarded $40,000 to support the Ellensburg Business <br />Development Authority (EBDA) as a subcontractor <br />BACKGROUND: <br />Resolution 2019-164 formalized the Council of Governments (COG) 2019 awards of <br />Distressed County Funding through the Public Facilities Fund (108). $40,000 was <br />awarded to the City of Ellensburg supporting the EBDA. The county's grant agreement <br />does not allow subcontracting without written approval from the BOCC. <br />DISCUSSION: <br />The EDBA submitted an application for funding to the COG. Direct submission of the <br />application suggests that the EDBA is qualified and capable of managing grant award. <br />Submission of two grants in a single grant award cycle by the same entity is prohibited. <br />The City of Ellensburg is acting as the prime contractor and suggesting the EDBA is a <br />subcontractor for the purpose of administering grant award. Presuming the BOCC agrees <br />to allow the City to administer grant award, has the City violated the requirement to <br />submit a single application for funding? <br />Section 3a of the County's funding agreement requires written consent from the County <br />for subcontract performance prior to utilizing distressed county funds.
