Cook RECOMMENDATION: Issue the "Notice of Intent to Formulate Road Improvement District No. 2018-01 Wiehl Road" and schedule the public hearing for 2:00 PM local time, November 201h, 2018 in the Commissioners auditorium. BRIEFING SUMMARY: • RID formulation begins with the resolution stating the Board's intent to formulate (EXHIBIT 1) • Specific language and exhibits are required to accompany the resolution • Formulation is pursuant to an Ordinance following a public hearing • Legal notice is required and the resolution must be published in the County's paper of record for a minimum of two consecutive issues at least fifteen days before the fixed date of the hearing • The Ordinance has required and optional language as prescribed in Revised Code of Washington 35.43. BACKGROUND: For the past several years, Public Works has been working towards formulating the Wiehl Road Improvement District. Recent outreach to benefited property owners affirms a minority of opposition (4 of 66). DISCUSSION: The resolution has specific requirements in law for inclusion. Public Works has attempted to ensure compliance with state law requirements. It might be beneficial to have the Board's attorney review our work prior to Board action.
