Cook <br />RECOMMENDATION: <br />Oppose the Washington State Department of Ecology's effort nominating the County for <br />a MS4 permit. <br />BRIEFING SUMMARY: <br />WA Department of Ecology (WADOE) is preparing to reissue Municipal <br />Separate Storm Sewer System (1\4S4) National Pollution Discharge Elimination <br />System (NPDES) Phase I1 permits in 07119 <br />• WADOE Central Region is interested in pursuing an MS4 permit for Kittitas <br />County <br />• Public Works has prepared a response to WADOE <br />• An MS4 permit is not warranted nor is it in the interest of Kittitas County <br />BACKGROUND: <br />NPDES Phase II (EXHIBIT 1) implementation began nationwide in the 1990s. Initially, <br />the largest population centers were captured in the legislation. WADOE wrote several <br />MS4 permits in 2014 (Ellensburg got one — EXHIBIT 2) and WADOE is now preparing <br />to reissue MS4 permits. The Central Region of WADOE is expressing interest in <br />nominating Kittitas County for an MS4 permit. The process utilitzes "Petition Criteria" <br />(EXHIBIT 3) allowing WADOE to force Kittitas County into securing an MS4 permit. <br />Six separate "factors" are evaluated when considering "nomination". <br />DISCUSSION: <br />The six nomination criterion are: <br />• Factor 1: Does the municipal separate storm sewer discharge stormwater to impaired <br />or sensitive waters? <br />Page 1 of 8 <br />
