CONTRdCT SPECIAL PROVISIONS <br />1.0 INTRODUCTION <br />1.1 The following spacial provisions are to be used in conjunction with the 2016 edition of the <br />Washington State Department of Transportation's °Standard Specifications for Road, Bridge, <br />and Municipal Construction" M 41-10, as amended, which by reference are hereby made a <br />part of these documents. <br />1.2 The special provisions hereinafter contained shalt supersede any conflicting provisions of <br />the Standard Specifications, <br />1.3 Where the word State appears in the Standard Specifications, the County of Kittrtas shall be <br />used in this contract. Where the terms Engineer or Secretary of Transportation appears in <br />the Standard Specifications, Kittitas County Public Works Director shall be used for this <br />contract. Where the term Washington State Highway or Transportation Commission <br />appears in the Standard Specifications, Klttitas County Board of County Commissioners <br />shall be used for this contract. <br />1.4 Prospective bidders will herby referred to as the Bridge Manufacturer. <br />2.0 DESCRIPTION OF WORK <br />2.1 This Work provides for the Design, Fabricating, Finishing and Transporting of a Steel <br />Modular Bridge to Kittitas County Public Works, <br />3.0 STANDARD TERMS AND CONDITIONS <br />3.1 No alteration in any of the terms, conditions, bid price, quality, quantities, or specification of <br />this order will be effective without written consent of the Mitas County Department of Public <br />Works. <br />3.2 Before award of a public works contract, a bidder must meet at least the minimum <br />qualifications of RCW 39.D4.3513(1) to be considered a responsible bidder and qualified to be <br />awarded a public works project. <br />3.3 Bridge Manufacturer agrees to protect and save harmless Kittitas County against all claims, <br />suits, or proceedings for patent, trademark, copyright or franchise infringement arising from <br />the purchase, installation, or use of goods and materials ordered, and to assume all <br />expenses and damages arising from such claims, suits or proceedings. <br />3.4 Bridge Manufacturer warrants and represents that all the goods and materials ordered <br />herein are free and clear of all liens, claims or encumbrances of any kind. <br />3.6 Bridge Manufacturer agrees to bear all risks of loss, injury, or destruction of goods and <br />materials ordered herein which occur prior to delivery. Such loss, injury or destruction shall <br />not release Bridge Manufacturer from any obligation hereunder. <br />3.6 The Bridge Manufacturer agrees to and shall defend, indemnify and hold harmless the <br />County, its appointed and elective officers, agents and employees, from and against all loss <br />or expense, including but not limited to judgments, settlements, attorney's fees and costs by <br />reason of any and all claims and demands upon the County, its elected or appointed <br />officials, agents, or employees for damages because of personal or bodily injury, including <br />
