PARTIES OF THE AGREEMENT This Project Agreement (Agreement) is entered Into between the State of Washington the Recreation and Conservation Office, P.O. Box 40917, Olympia, Washington 98504-0917 and Kittitas County by and through the Kittitas County Public Works (sponsor), 41,1 N Ruby St Ste 1, Ellensburg. WA 98926 and shall be binding on the agents and all persons acting by or through the parties, B. PURPOSE OF AGREEMENT This Agreernent sets out the terms and conditions by which a grant is made to implement projects under the Yakima Integrated Pian of the State of Washington. The grant is administered by the Recreation and Conservation Office (RCO) to the sponsor for the project named above per the director's authority granted in RCW 79A25.020. C. DESCRIPTION OF PROJECT Kiitltss County will acquire fee simple title to one 40 acre and one 20 acne property, they will acquire a conservation easement on a third 60 acre property, and they will obtain an appraisal to acquire a forth 20 acre property. All properties are located along the Ringer Loop reach of the Yakima River, south of Ellensburg. In addition, Kirtitas County will complete preliminary designs and permits for a habitat restoration project on the 60 acre conservation easement. The goal of time project is to protect and expand riparian habitat and to facilitate future off -channel fish habitat enhancement and road decommissioning. Rsh that are targeted to benafit from the project include steelhead, spring Chinook, Coho, Sockeye, and Cutthroat Trout. D. PERIOD OF PERFORMANCE The period of performance begins on February 29, 2015 (project start date) and ends on June 1, 2017 (project end date). No allowable cost incurred before or after this period is eligible for reimbursement unless specifically provided for by written amendment or addendum to this Agreement or specifically provided for by policies published in RCO manuals as of the effective date of this agreement. The sponsor must request extensions of the period of performance at toast 60 days before the project and date. The sponsor has obligations beyond this period of performance as described in Section E: On-going Obligations. E. ON-GOING OBLIGATIONS For the acquisition portion of this project, the sponsors on-going obligations shall be in perpetuity and shah survive the completionhar nination of this Project Agreement unless otherwise identified in the Agreement or as approved by the funding board. it is the intent of the funding board's conversion policy (see Section 24: Restriction of Conversion) that all lards acquired and or facilities and areas developed, renovated, or restored with funding assistance remain in the public domain in perpetuity. For the planning portion of this project, the sponsors on-going obligation shall be the same as time period of performance identified in Section D: Period of Performance. F. PROJECT FUNDING The total grant award for this project shall not exceed $988,452.00. RCO shall not pay any amount beyond that approved for grant funding of the project and within the RCO's percentage as identified below.
