COMMISSIONER JEWELL explained how the <br />responsibility would be with the applicant to provide recorded <br />easements with the permit application documents. <br /> <br />THOSE PRESENT & TESTIFYING: JERRY MARTINS felt it may be a slippery <br />slope for the County to approve the proposed amendment, and opening <br />the door to private, civil issues that the County would not want to <br />become involved in. He expressed concerns with easements that may <br />not be recorded, as well as setbacks and well easements. THERE BEING <br />NO OTHERS REQUESTING TO TESTIFY, THE PUBLIC PORTION OF THE HEARING <br />WAS CLOSED. <br /> <br />ITEM 16-03 OPEN SPACE RESPONSIBILITY: MR. HANSEN described proposed <br />changes including how the amendment would place the responsibility <br />of maintaining Open Spaces upon the residents of the particular <br />development. He reviewed proposed language and submitted information <br />into the record from Mr. Mitch Williams. Staff recommended approving <br />the proposed changes. <br /> <br />THOSE PRESENT & TESTIFYING: JERRY MARTENS said he was confused if <br />the County was trying to set up a separate Open Space Tract and <br />commented on requirements of the Growth Management Act. THERE BEING <br />NO OTHERS REQUESTING TO TESTIFY, THE PUBLIC PORTION OF THE HEARING <br />WAS CLOSED. <br /> <br />ITEM 16-04 CHANGES TO USE TABLES: MR. HANSEN reviewed proposed <br />changes to Use Tables and new definitions. <br /> <br />THOSE PRESENT & TESTIFYING: NONA WALLACE asked for clarification of <br />special care dwellings. JERRY MARTENS said he was in favor of the <br />proposed changes and encouraged the County to go even beyond where <br />they were currently taking it. JOHN RANKMA expressed concerns with <br />special care dwelling and mobile home parks in urban grown areas and <br />how it could change the density and surrounding areas. MICHAEL <br />BELIEU questioned how a mobile home park could relate to agriculture <br />and was concerned about not being notified about any projects that <br />may not be directly in their area. STAN BLAZYNSKI provided <br />information on mobile home parks. THERE BEING NO OTHERS REQUESTING <br />TO TESTIFY, THE PUBLIC PORTION OF THE HEARING WAS CLOSED. <br /> <br />ITEM 16-05 TRANSFER OF DEVELOPMENT RIGHTS: MR. HANSEN reviewed <br />proposed changes to Transfer of Development Rights and how there <br />would be no requirement for TDR credits when at least 30% of any <br />development provides affordable housing. <br /> <br />THOSE PRESENT & TESTIFYING: MICHAEL BELIEU said he felt uneasy about <br />the proposed amendment as it would encourage more developments in <br />areas that would not necessarily be developed, such as the proposed <br />affordable housing project by HopeSource on Pfenning Road. GLENDA <br />KALLAS questioned if the proposed amendment would change the density
