Cook <br />RECOMMENDATION: <br />Calendar the policy for adoption. <br />BACKGROUND: <br />The Federal Aviation Administration (FAA) is requesting the County adopt its <br />disadvantaged business enterprise (DBE) policy, as a condition of funding the <br />airport master plan revision. Public Works (PW) provided our adopted DBE <br />policy with Federal Highway Administration (FHWA) to the FAA and rejected it for <br />use. <br />PW prepared a draft FAA policy presenting it to the Board of County <br />Commissioners (BOCC) in late 2015. At the time of presentation, PW had not <br />received comments from the Prosecuting Attorney's office (PA). Recently, we <br />received comments from the PA on our draft FAA DBE policy. <br />DISCUSSION: <br />PA review identified one item for PW consideration and revision at Subpart F — <br />Compliance and Enforcement. The preferred FAA language attempts to <br />circumvent disclosure law using the term: "Notwithstanding any provision of <br />Federal or state law". PA suggested language is: "To the extent allowed by any <br />provision of federal or state law". PW has made the requested change to the <br />proposed FAA DBE policy and the change is provided (EXHIBIT A) for BOCC <br />review. <br />Adoption of the policy is a requirement of FAA supporting the master plan update <br />for Bowers Field. <br />FISCAL IMPACTS: <br />The planning grant has been accepted and contract work is underway. <br />ATTACHMENTS: <br />EXHIBIT A: REDLINE CHANGES TO DRAFT FAA DBE POLICY <br />Page 1 of 1 <br />PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT <br />
