KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS <br />STUDY SESSION! STAFF REPORT <br />STUDY SESSION! DATE: September 12, 2016 <br />TOPIC: Surplus Property Requested Discount Price <br />ACTION REQUESTED: Provide Direction to Staff <br />LEAD STAFF: Mark R. Cook <br />RECOMMENDATION: <br />Direct staff to respond to the applicant's request to discount the price of surplus <br />property (18-18-27069-0057). <br />BACKGROUND: <br />The applicant (Mr. David Duvall) has been attempting to construct covered <br />storage at his residence adjacent to tax parcel 18-18-27069-0057 for the past <br />several years. An initial attempt at construction resulted in removal of a covered <br />facility as a result of threatened code enforcement action. Mr. Duvall contends <br />that he was not made aware of required side yard setback requirements when <br />originally inquiring about exempt structures several years back. After hiring a <br />contractor and constructing the improvement, the side yard setback violation was <br />discovered by CEDS and enforcement action began. Mr. Duvall voluntarily <br />removed the structures and is convinced that process failed him by not making <br />him aware of the side yard setback restriction prior to constructing the <br />improvement. <br />DISCUSSION: <br />Adjacent to this property 2110 West Clearview Drive, is a surplus property (18- <br />18-27069-0057). Mr. Duvall has been maintaining the property for several years <br />(watering/mowing) and has invested personal funds in grounds maintenance. <br />The property is believed to be sufficient for the desired covered storage adjacent <br />to his property. <br />FISCAL IMPACTS. <br />Mr. Duvall contends that the financial burden associated with his failed original <br />attempt at constructing covered storage was his alone and that the County erred <br />by not informing him of the required side yard setback. He further asserts that <br />his personal investing on the parcel should be considered when addressing the <br />minimum bid value of tax parcel 18-18-27069-0057.
