<br />08/16/2016 MINUTES 4 <br /> <br /> <br />ADMINISTRATIVE MATTERS <br /> <br />WAIVER TIM RAVET COMMISSIONERS <br /> <br />Commissioner Osiadacz moved to amend a previous decision by the Board on <br />August 15, 2016, and to approve granting a waiver to the Noise Ordinance <br />(Kittitas County Code Chapter 9.45), for a party on September 3, 2016 <br />until 3:00 a.m. on September 4, 2016 at 5595 Vantage Hwy Ellensburg, WA <br />on the condition of notifying neighbors of the party that are within a <br />500 foot radius of the party’s location, to be submitted to the <br />Commissioner’s office no later than August 26, 2016. Commissioner <br />Jewell seconded. Motion carried 3-0. <br /> <br />CITIZEN COMMENTS ON NON-AGENDA ITEMS <br /> <br />BOARD DISCUSSION/DECISION ITEMS – NONE <br /> <br />MISCELLANEOUS - NONE <br /> <br />EXECUTIVE SESSION <br /> <br />At 10:12 a.m. Chairman O’Brien announced the Board would recess into <br />Executive Session with Neil Caulkins, Deputy Prosecutor for 15 minutes <br />to discuss with legal counsel representing the agency matters relating <br />to agency enforcement actions, or to discuss with legal counsel <br />representing the agency litigation or potential litigation to which the <br />agency, the governing body, or a member acting in an official capacity <br />is, or is likely to become, a party, when public knowledge regarding the <br />discussion is likely to result in an adverse legal or financial <br />consequence to the agency. No action anticipated. <br /> <br />At 10:17 a.m. the Board reconvened out of Executive Session. No action <br />taken. <br /> <br />At 10:17 a.m. Chairman O’Brien announced the Board would recess back <br />into Executive Session with Neil Caulkins, Deputy Prosecutor for 10 <br />minutes to discuss with legal counsel representing the agency matters <br />relating to agency enforcement actions, or to discuss with legal counsel <br />representing the agency litigation or potential litigation to which the <br />agency, the governing body, or a member acting in an official capacity <br />is, or is likely to become, a party, when public knowledge regarding the <br />discussion is likely to result in an adverse legal or financial <br />consequence to the agency. No action anticipated. <br /> <br />At 10:27 a.m. the Board reconvened out of Executive Session. Direction <br />was given to Staff to continue negotiations. <br /> <br />
