FEBRUARY 24, 2016 <br /> <br />Board members present: Vice-Chairman Paul Jewell & Commissioner Gary <br />Berndt. Absent: Chairman Obie O’Brien. <br /> <br />Others: Mandy Buchholz, Deputy Clerk of the Board; Neil Caulkins, <br />Deputy Prosecutor Greg Zempel, Prosecutor; Peter Dykstra, Special Deputy <br />Prosecutor for Kittitas County; Robin Raap, Administrative Assistant and <br />Craig and Nancy Schnebly. <br /> <br />SPECIAL MEETING WATER RIGHT AGREEMENT COMMISSIONERS <br /> <br />At 3:00 p.m. Vice-Chairman Jewell opened a Special Meeting to <br />consider a Water Right Purchase and Sale Agreement with Craig & <br />Nancy Schnebly. <br /> <br />Vice-Chairman Jewell presented the Board with a Water Right Purchase <br />& Sale Agreement with Craig & Nancy Schnebly. He explained the <br />attached Exhibits and noted that there is no longer an Exhibit E. <br /> <br />AGREEMENT CRAIG/NANCY SCHNEBLY COMMISSIONERS <br /> <br />Commissioner Berndt moved to approve and authorize Vice-Chairman’s <br />signature on Water Right Purchase & Sale Agreement for the purchase <br />price of the 1886 Water Right and the County’s portion of the 1871 <br />Water Right is Four Thousand Six Hundred Thirty-Two Dollars and <br />Forty Five Cents ($4,632.45) per acre-foot of consumptive water use <br />approved by the Washington Department of Ecology for transfer to the <br />Trust Water Right Program for mitigation of groundwater use in <br />Kittitas County, less the Earnest Money Deposit then held by the <br />Closing Agent and any interest earned thereon as presented. Noting <br />that the Sellers obligation to sell and Buyers obligation to <br />purchase is contingent upon the provisions of the Agreement; and <br />based on the calculation of at least 2.76 AF/acre of consumptive use <br />and will result in approximately 582.844 AF/year of consumptive use <br />for transfer into the Trust Water Right Program for mitigation of <br />groundwater use in Kittitas County. Vice-Chairman Jewell seconded. <br />Vice-Chairman Jewell and Commissioner Berndt both expressed their <br />appreciation to the Schneblys for assisting the County with this <br />extremely important part of the County’s history.
