KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS <br />STUDY SESSION STAFF REPORT <br />STUDY SESSION DATE: June 10th, 2019 <br />TOPIC: FISH Elmview Building Lease Public Hearing <br />ACTION REQUESTED: Approve of Notice of Public Hearing for July 2, 2019 at <br />2pm. <br />LEAD STAFF: <br />Mark R. Cook <br />RECOMMENDATION: <br />Schedule a public hearing for July 2, 2019 at 2:00 PM local time hearing testimony <br />regarding a proposed lease to FISH for use of the Elmview Building. <br />BRIEFING SUMMARY: <br />• The Elmview Building is currently leased by Elmview <br />• FISH has begun storing food items at the Elmview Building location with <br />permission from Elmview <br />• The Board desires alleviating Elmview from liability associated with FISH use <br />• The Airport Manger proposes having FISH sign a letter waiving liability for <br />limited use of the building by FISH ahead of lease decision by the Board of <br />County Commissioners (BOCC) <br />BACKGROUND: <br />Recently, representatives from FISH and Elmview met with the BOCC and Airport <br />Manager discussing the Elmview Building. It is our understanding that Elmview desires <br />retaining a limited office presence in the building while other accommodations are under <br />construction supporting Elmview's vacation of the Elmview Building. <br />DISCUSSION: <br />Staff sent a letter to FISH last week requesting their signature waiving liability and <br />holding harmless the County and Elmview for limited occupation of the Elmview <br />Building. It is staffs understanding that FISH is currently utilizing a porting of the <br />Elmview building for food storage and related activities. The waiver is intended to <br />provide a minimum level of risk protection to the County and Elmview as the Board <br />moves through the public lease process for FISH.
