Cook <br />RECOMMENDATION: <br />Informational briefing only — no Board action required. <br />BRIEFING SUMMARY: <br />• Board directed action obtaining Yakima lease is complete and has been routed to <br />the Prosecuting Attorney's Office <br />• Staff has also provided portions of Revised Code of Washington (RCW <br />14.08.120) <br />• The two items provide sufficient guidance resolving potential lease rates and <br />concerns over section 22 of our current lease <br />BACKGROUND: <br />• Current lease language is being opposed by hangar owners specifically section 22 <br />of the existing lease <br />• It appears that state law provides resolution likely acceptable to leasees <br />• Yakima imposes a set percentage of lease increase for every five year period and <br />audits the increase against the Consumer Price Index for Seattle, WA <br />DISCUSSION: <br />RCW 14.08.120 (5) appears to require arbitration resolving lease disputes between the <br />Board and leasees. PW has a legal request pending with the Prosecuting Attorney's <br />Office that will resolve the issue. Imposing a fixed percentage of increase and/or the use <br />of the consumer price index as measured in Seattle, WA provides predictability to leasees <br />and to Airport management.
