U.S. Department of Transportation SUPPLEMENT NUMBER 4 Federal Aviation Administration Application No. 27600 SUPPLEMENTAL AGREEMENT FA -WE -2426 DESCRIPTION or ADDRESS OF PREMISES: QTX RCLR and R/W (formerly Kittitas RML Site #5 and Access Road R/W) That portion of the E1/z SE'/a, Section 16, Township 17 North, Range 21 East, W.M., County of Kittitas, Kittitas, WA. Assessor Parcel #956102, County Map #17-21-16030-001 THIS AGREEMENT, made and entered into on July 1, 1962 by and between State of Washington, Department of Natural Resources, hereinafter called the State and the United States of America, Federal Aviation Administration, hereinafter called the Grantee or the FAA. WHEREAS, an easement was granted for the construction, operation and maintenance of a Microwave Repeater site to include the use of an existing access road; and, WHEREAS, the term of the agreement is for the period of use (until the rights are abandoned for the purpose which it was granted) with annual rental of $50 subject to review and adjustment every 5 years. WHEREAS, The State conveyed its property to Kittitas County per Quitclaim Deed dated December 22, 1986, Recording # 501400 subject to the easement granted to the FAA; and, WHEREAS, Kittitas County (Solid Waste) as the current landowner and the FAA wish to amend this agreement to reflect the current negotiated annual rent. NOW THEREFORE, these parties for the considerations hereinafter mentioned covenant and agree to amend the agreement as follows: 1. Consideration The FAA shall pay Kittitas County (Solid Waste Division) rental in the amount of $650 per annum in arrears for the term of the agreement. All payments shall be made payable by electronic funds transfer as required by P.L. 104-134 (10 USC 3332). Payments shall be considered paid on the day an electronic funds transfer is made. 2. This supplemental agreement (SA) supersedes and replaces Lease No. DTFANM-I0-L-00097 and any prior leases or agreements. All other terms and conditions of the agreement shall remain in full force and effect.
