KITTITAS COUNTY AIRPORT USE AGREEMENT <br />a. Liability insurance policy shall have the following provisions, at a minimum: <br />i. Premises liability coverage in an amount not less than $1,000,000 each <br />occurrence. <br />ii. Provide for not less than thirty (30) days in advance a written notice to Kittitas <br />County regarding any material change or termination of the policy. <br />b. Airpac hereby releases the County of and from every and all right, claim and demand <br />that Airpac may hereafter have against County, its successors or assigns, arising out <br />of or in connection with any loss or losses occasioned by fire and such items as are <br />included under the normal extended coverage clauses of insurance policies, and does <br />hereby waive all rights of subrogation in favor of insurance carriers against County <br />arising out of any losses occasioned by fire and such items as are included under the <br />normal extended coverage clauses of fire insurance policies, and sustained by Airpac <br />in or to the said Airport premises. <br />c. Airpac shall provide the County with a copy of said insurance policy upon reasonable <br />request by the County. <br />11. INDEMNIFICATION: Each party herein shall defend, indemnify, and hold the other party, <br />its successors and assigns, and the respective directors, officers, employees, insurers, agents <br />and representatives of the other party completely harmless from and against any and all <br />claims, suits, demands, actions, liabilities, losses, damages, judgments, or fines arising by <br />reason of injury or death of any person, or damage to any property, including all reasonable <br />costs for investigation and defense thereof (including, but not limited to, attorney fees, court <br />costs and expert fees) of any nature whatsoever arising out of that party's conduct at the <br />Airport, or in its use or occupancy of the Airport premises, regardless of where the injury, <br />death, or damage may occur, except to the extent such injury, death, or damage is caused by <br />the negligent act or omission or willful misconduct of the other party. <br />Any personal property of Airpac or of others placed in the Airport premises or placed <br />anywhere on the Airport shall be at the sole risk of Airpac or the owners thereof and the <br />County shall not be liable for any loss or damage, except to the extent such loss or damage <br />was caused by the negligence of the County. <br />The provisions of this Section shall survive the expiration or termination of this Agreement. <br />12, AIRPORT TRAFFIC: It is understood and agreed that the Airpac's use of the Airport <br />premises shall not unreasonably interfere or restrict the use of aircraft landings, take -offs, <br />storage of aircraft, taxiing, and movement of ground vehicles. Airpac shall comply with all <br />rules and regulations of the Federal Aviation Administration, Washington State Department <br />of Transportation Aeronautics Division, and the Kittitas County Airport Standards. <br />13. FIREARMS: Hunting or discharging of firearms will not be permitted on or from said Airport <br />premises. <br />PAGE 3 <br />
