KITTITAS COUNTY AIRPORT <br />DEPARTMENT OF PUBLIC WORKS <br />AIRPORT USE AGREEMENT <br />THIS AIRPORT USE AGREEMENT made and entered into this 20th day of <br />January , 2020 by and between KITTITAS COUNTY ("County), a municipal <br />corporation in the State of Washington, and AIRPAC AIRLINES, INC., WEST AIR, INC. AND <br />PCALG 208 LEASING COMPANY, LLC ("Airpac"), a company authorized to do business in the <br />State of Washington (collectively referred to as the "parties"); and <br />WHEREAS, Airpac is a certified airline cargo service provider which intends to provide <br />cargo services under contract for UPS (United Parcel Service) at the Kittitas County Bowers Field <br />Airport ("Airport"), and the parties hereto desire to set forth the operating privileges and <br />responsibilities of Airpac at the Airport; and <br />WHEREAS, this Airport Use Agreement herein referred to as the "Agreement" is made in <br />accordance with Chapter 19.04 of the Kittitas County Code ("KCC") and is subject to said code, as <br />amended; and <br />NOW THEREFORE, in consideration of the mutual promises made in this Agreement, the <br />parties agree as follows: <br />1. PREMISES: The County hereby agrees to allow Airpac access to Bowers Field for the <br />delivery of cargo to UPS employees for distribution. <br />2. PURPOSE: The purpose of this Agreement is to allow Airpac access to the Airport premises <br />for the purposes of the delivery of cargo to the residents of Kittitas County. <br />3. TERM: The term of this Agreement shall be for one (1) year and will commence on the date <br />of last signature of the parties hereto. This Agreement may, at the option of Airpac and <br />acceptance by the County, be renewed from year to year in accordance with the terms and <br />conditions herein specified. <br />4. USAGE FEE: Airpac shall pay to the County the total sum often dollars ($10.00) per landing <br />for the first 100 landings in a one-year period and then five dollars ($5.00) for every landing <br />thereafter in the same year. A monthly payment is due within ten days (10 days) from the last <br />day of the month. Airpac shall provide a landing record with each payment. <br />5. ADJUSTMENT OF USAGE FEE: Following the completion of the initial term of this <br />agreement, the County shall have the right to readjust the usage fee by negotiation with <br />Airpac for any year-to-year renewal term, but it is agreed that the fee shall not exceed <br />twenty percent (20%) of the previous year's fee. <br />PAGE ' <br />
