BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION NO. 2020 - <br />SUSPENDING PUBLIC WORKS PROCUREMENT PROCEDURES (RCW 39) AND <br />AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND SIGN <br />A BRIDGE PROCUREMENT CONTRACT WITH KNIFERIVER PRECAST <br />SUPPORTING THE COLEMAN CREEK FISH PASSAGE BARRIER REMOVAL <br />PROJECT AT VANTAGE HIGHWAY — CRP NO. 299-19 <br />WHEREAS: The Board of County Commissioners declared a Countywide State of Emergency <br />in Resolution 2020-042 responding to the COVID-19 pandemic; and <br />WHEREAS: The Governor of the State of Washington did declare a "Stay at Home" order <br />statewide on March 23`d, 2020; and <br />WHEREAS: The Department of Public Works did solicit material suppliers for a fish passage <br />structure supporting the Coleman Creek Fish Passage Barrier Removal Project at <br />Vantage Highway (CRP 299-19); and <br />WHEREAS: During solicitation KnifeRiver Precast requested providing an electronic bid in <br />response to that solicitation stating that the State "Stay at Home Order" prohibited <br />the delivery of the requested bid and Public Works does not currently support <br />electronic bid submittals; and <br />WHEREAS: Public Works received no bids pursuant to its solicitation for bridge structure <br />submittal CRP No. 299-19; and <br />WHEREAS: Removal of fish barriers is a high priority for the State of Washington and the <br />Washington State Department of Fish and Wildlife qualifies this project as a <br />barrier removal project pursuant to RCW 77.55.181; <br />NOW, THEREFORE BE IT RESOLVED that, pursuant to RCW 39.04.280, competitive <br />bidding is suspended as to this project. The COVID-19 outbreak has caused vast economic <br />disruption and damage due to the necessary social distancing precautions and associated government - <br />imposed lockdowns. This economic consequence is a part of the emergency. To combat that aspect <br />of the emergency the county wishes to stimulate the economy by continuing to pursue various public <br />works which are essential construction under the Governor's Stay At Home Order. <br />BE IT FURTHER RESOLVED that the Director of Public Works is authorized to negotiate <br />with KnifeRiver Precast for providing the necessary bridge structure removing the fish barrier on <br />Coleman Creek at Vantage Highway and sign the bridge procurement contract with KnifeRiver <br />Precast pending successful negotiations. <br />
