BOARD OF COUNTY COMMISSIONERS COUNTY OF KITTITAS STATE OF WASHINGTON RESOLUTION NO.2020- o 25 RESOLUTION TO APPROVE INTERLOCAL AGREEMENT BETWEEN THE KITTITAS COUNTY PROSECUTOR AND THE CITY OF ELLENSBURG FOR CITY DOCKET COVERAGE AND RECIPROCAL CONFLICT CASE ASSIGNMENTS WHEREAS, WHEREAS, RCW 39.34 which is the Interlocal Cooperation Act, provides that the capacity for public agencies to cooperate by providing services and facilities for mutual advantage; and the Kittitas County Prosecutor's Office and the City of Ellensburg have agreed to enter into an interlocal agreement for the prosecution of City and State misdemeanor and gross misdemeanor cases in conflict and to provide docket coverage to the City Prosecutor for sick and vacation leave; and WHEREAS, as part of the responsibilities per the terms of the agreement, the Kittitas County Prosecutor's Office will handle district court cases that are assigned based on conflict from arraignment through final disposition concurrent with the terms of the agreement, as will the City of Ellensburg handle State misdemeanor and gross misdemeanor cases that are assigned based on conflict and will handle these cases from arraignment through final disposition. The Kittitas County Prosecutor's Office will fill in as requested by the City of Ellensburg to cover illness and vacations of the City prosecutor as stipulated in the terms of the agreement. NOW THEREFORE' BE IT RESOLVED that the Board of County Commissioners of Kittitas County, Washington, hereby ratifies Gregory L. Zempel's signature on the interlocal agreement with the City of Ellensburg, which is attached hereto and incorporated by reference. DATED this INTT.,day of at Ellensburg, Washington.
