FINAL Ms' I 1 1/16/2020 <br />5.4.2. Construction of New Structures and Expansion of Existing Structures. Grantor <br />may construct additional Improvements not existing as of the Effective Date of <br />this Easement and may expand or enlarge Improvements existing on the <br />Protected Property as of the Effective Date of this Easement provided those <br />structures and improvements are located within the Building Envelopes (as <br />defined below in Section 6.6.2), are in compliance with the Purpose and terms <br />of this Easement, and are subject to the impervious surface limitations and <br />restrictions on new Improvements provided for in Section 6.6. <br />5.4.3. Reservation of Dwelling Units. Grantor reserves the right to use, maintain, repair, <br />replace, expand and/or enlarge existing single-family dwelling units and to construct <br />new single-family dwelling units within the Building Envelopes on the Protected <br />Property (collectively, the "Dwelling Units"), subject to applicable government rules <br />and regulations and subject to the impervious surface limitations and restrictions on new <br />Improvements provided for in Section 6.6, for the sole purpose of accommodating the <br />Grantors and their successors in interest to the Land or any portion thereof, the farm <br />operator(s), and/or the families of such persons, or for accommodating agricultural <br />employees of the owner(s) or operator(s) and their families. No more than three (3) <br />Dwelling Units in total will be permitted at any one time on the Protected Property and <br />all must be located within the Building Envelopes. As of the Effective Date of this <br />Easement, Grantor utilizes two (2) buildings as Dwelling Units: Grantor's primary <br />house and a pump/well house. At such time as the pump/well house is no longer used <br />for dwelling purposes it will not be considered a Dwelling Unit for purposes of this <br />Easement. <br />5.5. Water Rights. The Parties agree that the Dedicated Water Rights must be maintained <br />on the Property to ensure the protection of the Agricultural Conservation Values. <br />Grantor may exercise the Dedicated Water Rights by putting them to any beneficial use <br />that is not inconsistent with the Purpose and terms of this Easement, and that is not <br />prohibited herein. Grantor may maintain, repair, and if destroyed, reconstruct or replace <br />any existing facilities relating to the Dedicated Water Rights (such as ditches, wells <br />and reservoirs) with notice to Grantee as provided for in Section 7, provided that such <br />activities are carried out in compliance with the Purpose and terms of this Easement. <br />5.6. Recreational or Educational Use. Grantor may engage in, and allow others to engage <br />in, recreation or educational activities on the Protected Property. Recreational uses are <br />limited to uses such as hiking, fishing, horseback riding, and other forms of recreation <br />that do not require site modification to accommodate motorized, mechanical or <br />electronic accessories. All forms of developed recreation or recreation that adversely <br />impact the Agricultural Conservation Values are prohibited. <br />All recreational and educational activities on the Protected Property shall be carried out <br />in compliance with the Purpose and terms of this Easement, and in a manner that <br />in <br />
